  • Looks like a great bit of evidence to be shared in the event of court proceedings that they think £15 is what they actually lost.
    It is actually £15 too much because if they ignored the car they would not have even lost anything by mitigating the loss.

    I would run the clock down then inform them at the last day that no independent appeals within the timescale = no keeper liability.
    Bye, unless they fancy a day in court.

    Did the unedited appeal template really include an offer of £15 to settle? Don't pay them a penny!

    You should respond along the lines of:
    - Yes, you researched their sordid little outfit on the internet, and why not. It was most revealing of how disreputable they are.
    - Your research did, indeed, find the Parking Eye V Beavis and Wardley case, and it also showed that it is not case law, and it is being appealed anyway. You find that their not mentioning that rather crucial fact, and claiming it to be case law, as deceitful at least, if not downright dishonest.
    - Your internet research also found out that the BPA Code of Practice, to which they are bound, says that a POPLA code should have been sent with their appeal response, and so they will be reported to the BPA for that breach, and you now expect said POPLA code by return.

    I would add:
    "I find it despicable how you sully the name of the British Legion by presenting an affiliation with such a magnificent organisation. Whilst the Legion honours the momories of those who have fought and died to win freedom for us all, your lies, misrepresentation and attempts to dupe/scare money out of ordinary citizens is at complete odds with everything the British Legion stands for. Shame on you."

    thanks Marktheshark I like that idea. how many days does the ppc have to provide me with a popla code? just browsed the newbies sticky again but couldn't see the answer, i'll keep looking.

    It doesn't work like that. They are already in breach by not sending you a POPLA code. They don't have extra time to fix the problem.

    You might as well get the ball rolling by complaining to the BPA at aos@britishparking.co.uk

    Writing to them after 35 days elapses will achieve nothing but the waste of a stamp; only the BPA will get anything done now.

    perfect, thank you hoohoo, I've already got the ball rolling with bpa so I think I will leave things alone for a while now and see what happens.

    time to update my thread: 05/01/15 i received a response to my email complaint from the bpa as follows:

    "I have contacted the operator and they have advised they have sent out a further letter which will contain your POPLA verification code.

    This has been sent out by first class post. However, I have also provided you with a copy in the attached.

    In view of the above, this will allow you the 28 days to appeal to POPLA.

    Thank you for bringing this matter to my attention."

    as it says, there was a pdf document attached showing me what legion group had mailed out that same day and i did receive it in the post the following day 06/01/15.

    here is the letter i received from legion group:

    "Thank you for your email received 31st December 2014.

    This came in response to a letter sent by Legion Group dated the 24th December 2014.

    We acknowledge that we omitted to provide you with the POPLA code requested. Please find this information enclosed with this letter."

    now i have my popla code :)

    i am going to put together my popla appeal and post it here for feedback before i file it on the popla website.

    i just have a couple of questions that will help me put my appeal together please:

    on the popla appeal form there are four boxes i can tick for the reasons for my appeal, do i just tick the one box that says "I am not liable for the parking charge"?

    i also have pictures of the car park showing how poor the signage is (and it is poor), do i even need them?

    i'll start work on my popla appeal letter...
  • Glad to see you're making progress with these 'people'.

    I think the usual advise is tick all the boxes apart from stolen.

    Pictures of poor signage are probably not going to sway POPLA, not when they have GPEOL etc to scan read for when they process your appeal.
