G24 do NOT own the land. Complain to the gym manager (not just Head Office) and also try a complaint to your local paper and your local MP.

Wait a minute - I take it it's impossible for your son to have been the driver? If so, was the Notice to Keeper received within 15 days of the parking event? This might just be worth a certain appeal to the IAS, how long do you have left out of your 21 days since the rejection letter? Can you show us the NTK letter, the first one? BOTH SIDES. Who appealed? You? Did you admit who was driving?

Ive complained to gym head office, local newspaper are happy to write a feature about it. I have never received a Notice to Keeper from G24. In my appeal, I stated that we had received a charge, but didnt admit who the driver was. The rejection email was received yesterday, so 20 days left.

You have - it's this (otherwise sometimes called a PCN or CPN or whatever the scum call it):
Few days later, received a parking charge from G24, stating the car overstayed by 20 mins.
That's the document I would like to see both sides of, and is there a way you could 'prove' in documentation to the IAS that the keeper cannot possibly drive so cannot be held liable if the NTK is not compliant?

I think in an IAS appeal which we can help you with if you want to try, you could possibly also cite the Mental Capacity Act 2005 which protects him (and you as his representative) from liability for a contract:

[DOC]Sandwell MBC - Walsall Council

The 4 criteria for making a decision - The Act states that a person cannot make a decision if they cannot do any of the following four things:

• Understand information given to them relevant to the decision
• Retain that information long enough to be able to make the decision
• Use or weigh up the information available to make the decision as part of the decision –making process
• Communicate their decision by any means

Lack of capacity can be due to :

• A stroke or brain injury
• A mental health problem
• Dementia
• A learning disability
• Confusion, drowsiness or unconsciousness because of an illness or the treatment of it
• A neurological disorder
Finally I have been recently contacted by a journalist working on a documentary about private parking charges - particularly with regard to disabled people being threatened with charges. If you want to contact her, I am sure she would be interested in covering this case (but be careful NOT to say who was driving - and PLEASE edit your posts above where it says who was!):

Dear Coupon-Mad,
Snapper TV are making a documentary about private parking companies and the multi-million pound parking enforcement industry. We are interested in how such companies operate in retail parks, restaurants and hospitals around the country and what happens when a charge is issued.
One thing we're looking at is the problems disabled people face in particular. Mystery1 at Legal Beagles said you were the best person to speak to about this issue so I thought I would get in contact.
Would it be possible to speak to you today or tomorrow in more detail about our programme, and how you might like to get involved?
My contact details are
katherine@snappertv.co.uk and 07968 262 901.
Many thanks,
Katherine

Gym aren't the landowners. Its G24 that own the land. Ive emailed head office, who advise there really is nothing they can do. Ive since emailed back, advising, I am in process of finding a new gym, and I want my membership cancelled immediately.

Utter rubbish, there is no way G24 own the land. Please name the gym and what is the postcode ?

You now have two choices - follow Coupon Mad's as ever excellent advice or ignore G24. My personal choice is the later. G24 have never done court. They are a lying bunch of scammers who have broken contracts with their own suppliers, evaded paying VAT, put up false signage in some of their car parks, have phone operators who say "I couldn't give a s**t" when it's pointed out to them they have never done court and an owner, Adrian King, who is a threatening bully.

you are expected to COVER UP the paperwork such that you can scan it or take pictures of it (ie:- redact it) , in such a way as the personal details like name and address, the pcn ref number , your registration number etc are all covered up, then scan or snap it and put it onto tinypic or photobucket , then use a dead link to it in your reply, replacing the http with hxxp when you link it

that way regulars can see what they need to see but without your personal information , so nothing to identify you at all

another way is scan the document, redact the copy with marker pen or tippex , then scan that and put that on tinypic or photobucket

some people could photoshop it (not me) but I have outlined the easier ways of redacting it

you cannot upload anything onto here, hence the use of tinypic or photobucket , but you are correct in being cautious , nobody who is genuine on here (like those who have replied) want your personal details, plus we dont want G24 to identify you from any scans you provide

but its hard to help you without seeing the paperwork

Interestingly the car park signs still had the BPA logo on them in early December 2014, does that help us at all?

Just Google either or both, then set up a free account, give it access to your photo album (or image file), select the photos you want to upload, then for each of them scroll down the side of the window (could be either side) and look for the URL to post to a forum (IMG), copy it, paste it into a Reply Box on this thread. I think you've got sufficient posts to be able to post a live link - as is, direct from the hosting site.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
