    Unless they are a public company they have no legal requirement to declare their business operations. If you want the answer ask them yourself.

    I believe I have shown clearly you both to have edit out of context (or contextomy) EU standard legal clauses to suit your agenda in attempting to defame this business on your personal preferences. I show you such and the response is

    You should be aware that extracting text out of context and framing it in such a way could be deemed as libelous. And MSE's Terms & Conditions state

    You are entirely right to speak how you will. I am a HUGE proponent of free speech. But you should consider stating these things are of your personal opinion and cease framing them as fact when the facts clearly do not support you.

    The only fact you have provided that stands scrutiny is their previous marketing activity which appears to have since ceased. Which is a rule break (edit: this bit about rule break is purely assumption on my part), and boy you are tough on them.

    MSE have been in touch with me and I can confirm that I have absolutely no connection with this business, Sprinkle.com.

    I've never won from them, been in contact with them, or been contacted by them, nor have any vested interest in any outcome either. I have provided them with ample transparency of my real identity and my detailed reasons behind my actions in recent days.

    I would like to express that I also have zero ill feeling towards any one else here on MSE and only hope to increase all our chances of winning cool stuff and help them and the mods keep this place a safe place for us all to enjoy.

    First of all, sorry for the long long post.

    The Privacy Policy and terms are really long for legal reasons, it’s sad really. I had a few lines originally but the legal people required us to be covered. Most websites have extensive terms and in this modern litigative world we have to have them.

    That said we want to be honorable and play nicely. For example we gave a Radley watch away but the system picked two winners and they were notified automatically. Now from the terms and conditions, I am sure we could have wangled out of it. But I decided we should honor it, it was our mistake. I contacted the second winner and told them there would be delay.

    I don’t really want to get into picking apart the T&C’s , I am not qualified.

    Every action is voluntary, and the user gets to choose whether you do any particular action.

    We have companies offer to give us prizes, but in many circumstances they hope to get the emails associated with the entrants. We simply don’t do this as a rule. We did it one time on one of the first competitions. In the future if we do ever have a competition like that we will make it perfectly clear, giving you the user a chance to opt out. We may even introduce a transparency rating, to give an idea of how the competition runs.

    We ask winners to tweet, send us a photo, do review of even mention it in IWIWIW. None of these are required and no reward is done for it. I don’t see this as a problem, but if it is I can change how we do things. One upside to mentioning MSE however could be the fact that some posts I see are first time users, but that is new user for MSE.

    We don’t spam, we sent some emails to test the update preference system in December, but we turned this off.

    We monitor our inbox for UNSUBSCRIBE requests and action them, there is also an unsubscribe in each email now, that is not a password reminder or winners email.

    We can’t just sell your details on, it’s against the law. If members join via another source, we have to record that and be able to say the source. The ICO has a very powerful remit.

    The draw winner is picked randomly and is simply a matter of odds, sometimes people with very few entries win, other times a lot of entries. We removed the total number as some people were getting angry as they did not win, even though no assurances were made that the winner would be one of a higher entry number. I liken it to buying more lines on the National Lottery.

    I just checked on the system, the last 5 that I checked had the following entry numbers for the winner. So you can see it is spread.

    The daily winner is just if you have logged in that day.

    We try to get the prizes out fast and always trackable, mainly by Special Delivery, this gives us insurance should it go missing and in one case allowed us to see the husband of the winner had signed for the item without the wife knowing :-)

    We try our best to always have a real picture of the prize, to show we have it. You will no doubt have seen our red and blue "studio" beanbag. This is not always possible.

    Anyone can delete their account, at any time and all their data is gone, not like Facebook where you can “reactivate” it. This can be done by going to “my profile” scrolling down and re-entering the password.

    Email preferences are being added and we are just testing them, but this will control how, what a when you get emails. Here is a screen shot:

    As to why I am involved, it’s because it is fun, I think there is a better way to do it. Ultimately my aim is to create an awesome platform where people can be confident we won’t abuse the members trust.

    Freebies are going to be a big part of it in the future and with that we will allow companies to give you, the users options to get free samples. So for example if you are female and live in London we offer you the option to get that freebie, knowing that they will need your address or some other contact to reach you. You can choose to do this or not.

    Competitions and prize draws will be core to our brand.

    In light of all this, what could we do to make you happier, more confident in us?

    It’s a tough question. If it had to have one description it would be an startup incubator. We basically pick a project and run with it, then if it works it gets rolled out into another company in its own right.

    The story behind the pirate flag is one time Doug was invited to black tie do but he was told it was fancy dress. He went dressed as a pirate and everyone had photos taken with him.
