UKPC charge Dundee - Gallagher

Hi Folks

I like others have been charged and have done the online appeal foolishly admitting to being the driver. I have now received the the 'final reminder' after the initial rejection of appeal.

I have read many threads regarding the same (wished I had done this before appealing). My situation is that they have not got my vehicle registration quite right. They have one letter wrong. Can I use this somehow if I am summoned?

Any advice would be greatly appreciated.

  • Hold tight, read the newbie threads and ignore them from now on unless they are stupid enough to try court. Read the Courier website and you will see that even after court threats they backed out.

    If you've read threads here then you'll have seen that UKPC did actually file some claims earlier this year - then backed out when they realised they were going to get reamed. :)

    File and forget anything you receive except actual court papers.

    You don't get a summons! This isn't a criminal matter. But yes, keep all the paperwork, every letter, in case UKPC try a few more small claims next year or later (they have up to 5 years to make a claim in Scotland I believe, as anyone would with any 'debt').

    And complain to the owners of the Gallagher retail park - pretty sure I added their contact details recently into post #3 of 'Successful Complaints about PPCs' (a sticky thread among those collated by Crabman near the top of this forum). Have a look at post #3 of that particular sticky thread and find out who to complain to. The more people who do this, the more likely UKPC will get kicked out - and landowners often cancel for customers who complain.

    I think the best advice is to make no further contact with UKPC until you need to. Sending anything now will make them realise you're 'live' and it will encourage them to continue chasing you, hoping you'll crack under their pressure. You may have to endure a few debt collector letters (powerless), but they will stop eventually.

    My view is that the only time you need to respond to anything from here on is in the very unlikely circumstance of court papers being issued.

    If you read some of the other Gallacher/Quay Stores (same PPC) threads, you will see that UKPC and their Scottish debt collector don't play by the book.

    Therefore contacting them in any way is only going to give them further excuses to harass you. IMO you should keep stumm completely.

    Do NOT have any further contact with them, they are only intersted in scaring you out of your money.

    It is very common for PPCs in general, and UKPC in particular to make glaringly obvious errors on their tickets. The uninitiated often think this will give them grounds to get the ticket overturned, as it might with a real council PCN. However, in reality, if you contact them to contest the ticket on this basis, all you would be doing is outing yourself as the driver and saving them £2.50 applying to DVLA for your details. PPCs never cancel tickets with the wrong registration/colour/make or any other "minor details" they have messed up on. Don't forget, the only thing they are interested in is getting their hands on your money.

    The letter chain in Scotland is almost the same as NI, here is the junkmail you can expect, be prepared to play threatogramme Bingo.

    That's got hee haw to do with my correction. If you get court papers in a small claim in Scotland you get a summons. Criminal paperwork is a citation.
