End of tenancy - tenant still there but has somewhere else to live

  • I suppose if he doesn't move then if I give him the key, I'll be ok? Don't really want to do this, but I suppose everything would be legal then?

    I wouldn't have classed any of those statements from the tenant as formal notice to leave.

    Yes not overly official! I think I'll get the locks changed anyway and if he hasn't left, I'll just give him the new key.

    When you say in "writing" I take it you mean written / typed on a bit of paper, and signed...... Not text messages?

    There has been no firm written offer by the tenant of Early Surrender, acepted in writing by the landlord

    I'm not "changing the locks" per se - he broke the lock so he uses a screwdriver. I live 1.5 hours away. IF he does go on the 29th, I need to put a lock on - it's not about changing locks so he can't get in
    Any decent landlord would replace a broken/missing lock... and provide a key for the tenant (unless the tenancy had ended... see earlier posts)
  • I've told him I have a locksmith coming that day. He just said "ok". I need to get it done because it invalidates my insurance and I can't enter the property even if he did leave!

    I would have if I had known about it!

    He now knows I've got a locksmith coming

    As above, but added- you should serve a s8 now too and begin court proceedings first thing in the new year.

    Don't change the lock unless he's asked for it.
