    If no rent is charged, including any rent in kind or services provided in lieu of rent, then they aren't a tenant but an excluded occupier. This is documented on Shelters website and in their tenancy checker for England. Therefore no court order is required for eviction, just reasonable notice.

    Agreed, but this doesnt stop a claim for work in lieu. The Ops son has done work on the property, and could be 'house sitting'.

    The practicalities of eviction without a court order are also difficult, since you cannot physically remove them....
