Wrong Price Displayed

Hi and happy holidays to all....

A Food Processor in John Lewis was displayed in John Lewis at £249.99.

I ask the salesman to check to see if they had the chrome one in stock and when he returned, he said that the price of this is £281 and not the price displayed.

The price difference was checked with a shop floor manager, who said that the price labels sometimes fall off and sometimes are moved by their customers.

I challenged them, but the declined to sell the item at the price displayed.

I have taken a photo of the shelf of food processors where my selected item is displayed and that the higher price (£281) was not incorrectly placed on that shelf or another nearby.

I would like to raise this formally with John Lewis Customer Service and need some help on what grounds I should have been sold that item at the lower price displayed.

    Is it advertised on their website at the higher price?

    You have no rights as they did not sell you the product at a different price to the one displayed .

    The 4200XL is not on their website.


    They are showing the 3200XL and the 5200XL.

    There are no legal grounds on which you should have been sold this at the lower price. No contract is made until payment is accepted.

    If you feel that the store may be doing this systematically to tempt customers into the store or tempt them to buy when there then you can raise it with the ASA. But if successful that would result in John Lewis getting into trouble rather than you getting the item for the cheaper price, if you see what I mean?

    You are perfectly entitled to take the issue to John Lewis Customer Services. Tell them you are disappointed that they wouldn't honour the price. Ask them if they will honour it for you as a gesture of goodwill.
    The key thing to remember is that they don't have to do anything for you. If you go in all guns blazing then the chances are they'll tell you "tough". But if you come across as a nice customer, a regular, valued customer - someone who is worth keeping as a happy customer even if it means they lose £31 on the deal - then you might just get a result.

    Many thanks, but this has happened to me in Boots and they accepted the price was wrong and I was sold the item at a lower price.


    Isn't there something in contract law states that they are inviting you to buy with the price displayed ? Sorry I'm not fully conversant with the details of this.

    Even if it was correctly labelled they don't have to sell it to you.

    The Boots scenario was something they chose to do, they were not obligated to do so.
