No. It is probable that you weren't lucky, just that they assessed the amount of your claim versus what it would cost them to defend it, and decided to pay the claim. (If they defended and won they wouldn't get all their costs back). And they probably take this approach with most/all claims they receive - which is not likely to be too many. It's a numbers game to them.
If the number of claims against them increased significantly they might start defending some to give them some "case history" to scare potential claimants with. If they did defend then they'd have a better-than-even chance of winning (against someone in your situation).0 -

I don't think so. Even for someone in my "situation", if they waste people's time, provide no communication, and are unwilling to provide reasonable compensation when asked, they are still liable for the time wasted/inconvenience, even if there is no financial loss incurred. They are also responsible for selecting unreliable courier companies, with poor track records.
The advice received on this thread is very much binary: no proven financial loss = no ground for compensation or claim. I don't think it's that black and white, and I am happy to have raised a claim in spite of such advice, as per the actual result obtained.0 -
Don't get me wrong - I am happy you succeeded, and I'd love to see such a claim actually go to a hearing. It's just I don't think your case is as strong as you believe.
Of course you'll continue to believe the opposite. And neither of us will now ever know what would actually have happened.
