    It's dumb to say that it's dumb.

    If it were dumb, how do insurance companies make their money then?

    Any person with savings, except the most reckless ones, can unsure the phone themselves and save money by not contributing to the costs and profits of insurance companies.

    I'd be happy to have, say, £10K voluntary excess on my car insurance if this could reduce its price.
  • Insurance, when actuarially fair (and assuming we are considering a large insurer who pools risk) results in the total sum of all premiums received being equal to the total amount eventually paid out in settlements.

    So the insurer (in this perfect world) makes 0 from this - the area they make profit is investing your premiums with investment banks , hedge funds etc and achieving an 'x'% return. The same way that pension funds do.

    Of course, in the real world there are a number of market imperfections - one being insurers tightly written T&Cs that often result in genuine claims either being underpaid or not being paid out at all.

    All in all; evaluate your own risk of loss and make a decision. Either way, read the T&Cs. Then read the T&Cs again.

    Sorry to dig up an old thread but I'm having similar problems with Sony.

    I use my xperia Z2 all day every day in a professional capacity. On this day I put it in my front trouser pocket as I walked from vehicle to house. It rang, I took it out of pocket and it wouldn't work because a crack had appeared on the glass front. Not a single crack but maybe 2 or 3 small cracks from the same point of top edge.
    I did some research and discovered it a known problem with them. Contacted Sony and they told me to send it in. They reported back that I have damaged the screen in some way. It is under warranty but because I damaged it they wont fix it unless I pay £145.

    I have tried emailing them, phoning them, writing to them. They just stick to their opinion that I damaged the phone. Which I don't accept. All I did was put it in my pocket.

    So I am about to raise a small claims court action to make Sony fix the phone.

    I want to know if anyone has had any success with taking a similar case to court ?

    No point taking them to court yet. The court will require hard evidence (not simply "known problems" you've read about on the internet) for your case to stand any chance.

    First you'll need to get an independent's view of what caused the damage to the phone. If such an inspection (which you'll have to pay for) finds that the cracks are a result of an inherent fault then you can proceed further.

    If you win, the cost of the independent inspection will also be refunded.

    To be honest, it might be wiser to just pay to have it fixed. Your call.

    I would also recommend you have insurance if you use your 'phone in a "professional capacity"

    Yes I agree about the insurance but we have all heard about the tumble drier problems that are ongoing and I understand insurance does not cover them or any damage from them now because they are a known fault. Insurance is only for unforeseen issues not known problems. Sony themselves told me there is a known fault with some screens, but the way they decide if any particular crack is one of the faulty manufacturing ones or not is by looking at the screen and making a judgement. I know I did not hit the phone, bend it, or do anything to cause it to break. It had a screen protector on it and a gel cover. I've put lots of different phones in my pocket the same way and never had any problems. I've never made any previous insurance claim on a broken screen or anything else for that matter.
    I'm extremely careful with my phone as it is so important to me.

    The OP posted links to a bbc watchdog program about the issue.

    Does anyone know where I might find an expert witness to look at my screen ? It's still with Sony at the moment but I could get it back if needed.

    I have heard of lots of instances of this happening with xperia screens and Sony washing their hands. I'm hoping that a successful court case will force Sony to repair them.

    It's too late tonight but I will try and post pics up of the cracked screen

    Google or the Yellow Pages? It's not a "witness" you require, though. You'll have to arrange an independent inspection and, of course, it will be of no use to you if it agrees with Sony! Remember the cost is borne by you and will not be refunded unless you are successful in court.

    You can insure against accidental damage, though.

    It's also thoroughly debatable whether this is a "known fault"

    Definitely not related to tumble driers :)

    I know your being helpful and I thank you for that.

    but just being pedantic the tumble drier situation is that the manufactures have not admitted there is any fault (yet) so that too is in debate and yet the insurers are not paying out. Just saying cos insurance does not cover everything and anything.

    Might have a word with local trading standards about an independent inspection.
