Hello,


I'm new to this forum so I would like to greet first :)


I got a ticket at Leeds Crown Point Retail Park today :mad: It has been issued by Excel Parking Services Ltd. (member of BPA). The reason why I got it was that I have parked my car on the island between routes. I always park my car over there while busy (as it is now just before Christmas) and never got ticket before. There is no sign of "No parking" either double yellow line or other notice regarding parking not allowed in this area.
The parking attendant has used a contravention code as "A0) OTHER (SPECIFY)" and the reason he/she specified was: "Vehicle parked on pavement and not in a marked bay". I don't think it's a pavement as proper pavements are located at the sides of this island.
Could you please advise me what to do? Shall I appeal and if so, how to start and what to write in the letter/email? Hope I will get help from you experts ;) Sorry for my English.

    first of all take a look at the Sticky thread, at the top of this forum/message board

    If you have any trouble understanding it then say so.

    in breif....

    If you are the registered keeper:
    Challenge it to the parking company when you get a letter in the post

    If you are not the registered keeper, ( in other words its a lease car/rental car/hire, loan, company owned vehicle etc)
    challenge it immediately.

    They will most likely reject the challenge, and you should get a POPLA reference code, use that to construct a winning popla challenge/appeal and thats that.
    advice on how to challenge this (appeal ) at each stage etc can be found in the sticky thread at the top

    If you want to get rid of this as soon as possible a strong first challenge/appeal to the parking company combined with a complaint to the landowner may do it.

    As for the land owner, is this the place?

    It appears to be owned by the Crown Estate, and managed by some entity called Completely retail.
    wonder if the contracts are in order between the PPC and Crown Estates, or weather its just between the PPC and Completely ( clueless) retail?
    plenty of e-mail addresses/phone numbers and contacts on both completely retail and the crown estates site
    The Crown Estates are FOI'able as well
    From the Plain Language Commission:

    you only have to read the POPLA DECISIONS sticky thread to see that many people do in fact "win" it

    better to appeal it than be harassed for 6 years, providing you follow the correct procedures and use the correct words

    once you win at popla, its over

    I received a parking fine from Excel on the 22nd October for £40, I was at a mental health hospital visiting a tenant (In work time) I drove round for 20 mins but couldn't get parked so parked on an end, I was not obstructing anything and other cars were parked on the end without fines.
    I appealed the parking fine but was refused by Excel, of course, didn't expect anything less. I then appealed to Popla who have refused my appeal, I received this today and now I have to pay £100.
    Do you think I will need to pay it? Really cant afford it especially with being just after Christmas!! Once again sorry to invade, any advise is much appreciated,

    You do not have to pay when losing at POPLA, it's not a binding decision but is more likely to spur Excel into trying a small claim (don't panic and the chances of defending it are high and there are no large fees to add either, nor does a CCJ just happen!).

    Please do NOT click the New Thread button before reading the NEWBIES thread first, as already linked. We do not want (& can't handle) more new threads from people who haven't read the top NEWBIES thread first. As you have managed to come here too late to win at POPLA (we win every time so you missed a trick) you need to look at post #4 of the NEWBIES thread about ignoring any silly debt collector letters and post #5 of it if they try a small claim.

    It's defendable on a similar legal arguments you would have won POPLA stage with, if only you had known, even just Googled 'How to win at POPLA'.
