  • Wow, I wasn't aware that I could be liable to the LL's costs of evicting me…how much would that be?

    He told me he would drop papers here today but he hasn't. I worked from 9am until 7pm and after that had to look after child, do bed time and etc…no time to call Shelter today..I will have a longer break tomorrow so will do it then.

    It is a difficult decision, trying for social housing or remaining in the private sector…really hard situation. But even if I had a lot of spare money it would still be hard for me to find a property, pack everything and move in 8 weeks.

    Perhaps he has done a bit of homework and realised what a !!!! up he has made! Him not turning up to drop off whatever papers he had in store can only be a good thing.

    You won't be liable for any of landlord's 'evicting' costs if he's not doing it by the book.

    I'm not convinced you are liable for them even if done legit, but I may be wrong - ask Shelter about this.

    The tenant can be made to pay court fees and the bailiff fee if it comes to it. You could potentially be looking at around £400.

    The council shouldn't wait until the LL and T are at that stage of the process though before pulling their finger out and finding accommodation for the T. The T presenting the council with a valid Section 21 (or possibly a Section 8 depending on the Ground used) is supposed to be enough to show the council that the T isn't making themselves intentionally homeless.

    However, some councils seem to be putting tenants in a holding pattern waiting for court dates and bailiffs before doing this. If the OP does decide to go down the route of trying for social housing then once valid notice has been served speak with the council, hope that your dealing with someone at the council who knows what they're doing and if you're not put a rocket up their !!!!!.

    You have a contract with the LL which is protected by national law (statute), but you also have a civil contract, where you both agree to certain things in exchange for something else. It's that that you will be breaking by refusing to leave as you will have signed to agree to in your AST. Which is why the LL can sue you for his costs in returning him to the position he would have been in had you not broken the terms.

    He may well not bother though, and you probably have no other choice if you want the council to step in anyway. Really considering what you said in the OP, you should be in receipt of social housing.

    This is what is so utterly messed up with our private rental market. It was never designed or meant to be for people who would be classed as vulnerable or in need, and is completely unsuited to that purpose.
  • And don't forget, if he hasn't protected the deposit, the LL is in an awkward position as far as gaining possession of the property legally. He's going to have to jump through the 'return deposit' hoop. Risking you taking him to court for not protecting it.

    Once he issues you with a S21, go to the council. Don't listen to their excuses, get a homeless application made. Councils do seem to jump on any excuse to turn people away from their doors.., don't let them. You have a child, at some point you will be served with a S21, you will be considered in priority need.

    As discussed, it is likely you will be put in B&B in a cheap area, probably not local to you. But it should only be for 6-8 weeks. Some councils do extend this though. This is when you need to keep an MP or councillor on the case. Then you should either be offered more suitable temporary accomodation (like a flat) or social housing. But again, this could be anywhere. You could even be offered another private rental (councils can do this now).

    Also, one thing that seems to slip through a council's net.., a LL can gain a quicker eviction after the S21 has been granted by appointing High Court Sheriffs to evict a tenant. They don't notify the tenant, they just turn up with powers to evict within hours. So once the S21 has been cleared by the court, you need to apply pressure to the council if you can't find private accommodation yourself.

    Have not heard from the LL again. It has been two days since he called me asking for his flat back over the phone…
    I hope he doesn't turn up in 6 weeks time trying to move in.
    More questions: will the council provide any storage if I go to a B&B?
  • Received a simple letter from LL explaining that he needs to move back (2 months notice).
    Called Shelter and they took my details, someone will call me to book an appointment and explore my options.
    Called the council and they said that yes, I will get help with accommodation but not until it goes to court.
    So, if my LL contacts me and ask how is the new home hunting going, what am I supposed to do? Should I tell him straight away that I am not able to move within 2 months or just wait until nearer the time?
    I know Shelter will help me with these answers but I can't stop thinking about it. I really didn't want to cause inconvenience for the LL but at the moment a 1 bedroom flat around here is around £150/£200 more expensive then the rent I pay on this 2 bedroom flat! How Am I supposed to move?

    Once you have advice from Shelter, then you can decide how honest you want to be.
