Minor RTC on lane merging to left

  • If you're not planning to claim from your own policy for the damage, just tell your insurers anyway "for notification purposes only". At least then, you're acting within the terms of your policy and they aren't caught by surprise if the third party brings a claim, they aren't caught by surprise.

    Turning to the accident circumstances themselves, my guess is it probably would go 50/50 at any final hearing. The third party would probably try and say that he set off from the lights, you approached from behind at speed and when he tried to merge into the left lane, you continued to maintain your speed in an attempt to cut him off seemingly with the obstinate view that you were positioned in the "corrrect" lane at the time.

    Good advice - to be fair it has taken me 15 years to be able to calmly (well, most times....) deal with idiots on the road, so always a learning curve. Probably more luck than judgement when I was a new driver, but I've only been involved in 2 minor knocks, both times the other driver being at fault and accepting 100% liability.



    It's hard to back down when you're in the right/have right of way - try it in a lorry in central London with cars trying to bully you!
    Could have many prangs and come off best each time, but it's just not worth the time at the side of the road dealing with it.
    I suppose in my role as a 'professional driver' I have a duty to avoid such incidents if possible :p


    Just let them go and call them the c word a few times.

    I already notified my insurance company the morning after. The guy's number isn't calling any more, straight to voice mail on multiple occasions.

    I'm trying to get in contact with the council to get the bus lane footage at the time of the incident, it doesn't seem to cover the junction but it looks like it does cover the end of the merge in lane. I went back to the scene the other day and parked up and recalled approx where it happened and it seemed like he ran out of merge in road and must not have seen the raised pedestrian crossing with metal railings and panicked when he did see them. All assumptions of course but hopefully the cameras did catch something.

    Why didnt you just let him in then , instead of your pig headed stay at 30mph at all costs attitude ?

    If he wasn't in front of the OP then why would the OP have braked?


    Think this is a bit harsh.

    Its one of those it could be either vehicle at fault.

    You would have needed to witness it to see who was really at fault.

    It isnt , because the op doesnt accept 50/50 , when it is CLEARLY a shared blame incident

    Shared, but a little off 50-50 I would say.
    OP was in the 'driving lane' doing the correct speed, other chap needed to safely merge/change lanes, and invited the accident a little more than OP (IMO of course) :)

    By the time he was parallel with my drivers door he wouldn't of had time to merge in ahead of me. I believe now looking back that if I had actually slowed right down to let him carry on he would of probably gone into the railings anyway and caused an even bigger accident.
