I had something similar years ago.
Some idiot who didn't understand how bus lane times work, or what her blind spot/nearside mirror was for.
She nearly totalled me approaching the roundabout, then had another go around the roundabout, drifting into my lane and hitting my rear quarter panel. I was a good half a cars length ahead of her.
A decent statement, pics of the cars, and pics of the road and markings saw the insurance company decide on no faults for me0 -

You could have braked and let him in as you saw what was going on.

Good advice - to be fair it has taken me 15 years to be able to calmly (well, most times....) deal with idiots on the road, so always a learning curve. Probably more luck than judgement when I was a new driver, but I've only been involved in 2 minor knocks, both times the other driver being at fault and accepting 100% liability.0 -
I don't think that I would win in a small claims court, but I have my side and he would have his and it would be for the judge to decide. That's what my legal rep said it would come down to if I decided not to accept the 50/50.
I am not failing to comprehend anything, people are entitled to their opinions, as am I.
Its not an opinion. If you could have done something to prevent the accident you should have. But you didnt and then you had the afore mentioned incident.
This is the part you are struggling with. You were in the wrong. Proceed to tell us other wise, wont change the facts.0
