clarification of genuine hardship cases

Hi new to this forum but not to the site...
I am a single parent/full time carer on benefits and was looking up reclaiming
bank charges! And I was just wondering if anybody went down this route to
reclaiming bank charges. As far as I am aware it is illegal for banks to do this
as it is classed as a "financial hardship". If anybody has done this could you
give me some pointers as to how/what you did and did the bank pay up?

I've just been trying to reclaim charge of over £1000 and to cut a long story short we received a letter on the 27 July saying that because Abbey had help in the past by stop 5 of they extra charge that was all that they were willing to do.
At the moment my partner is of work sick (he hurt his self at work and now can not work maybe for some time) we have very little money coming in and two young children.
The charge they have since placed on our account have taken us way over our agreed overdraft and we are now getting charged interest and more charges each month with no way of clearing it i have read on this site about hardship circumstance that the banks should have in place.
Can anyone advice me wot to do0 -

Please can someone help? I have a claim outstanding with Abbey for nearly £3,000. I am now unemployed, so I would like to bring the case forward claiming financial hardship. Has anyone done this yet, if so, what should I put in the letter?0 -

Are you considering going through the ombudsman or the courtsAs I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
I have spoken to the Ombudsman - not really interested!, siad I should write to Abbey0

Has anyone asked their bank to continue with their claim because of genuine hardship/benefit reliant??
Ive sent several emails via online banking and they skirt the issue completely, just continue to say that after the test case they will write to all customers explainging what will happen, not even mentioning hardship cases!! aaarrrrggghh!!!!!!
They also say that they cannot gurantee that they will pay DDs/honour cheques/ and that they will add charges to my account and take the money!!(i had mentioned that the money should never have been stolen from my account as it was all benefits, and they have added another 110.00 this month and taken it from my benefits)!!
My emails have all quoted the s security act and the fact that they are supposed to continue to deal with claims when its a case of genuine hardship, but they ignore it!! just tell me that if i am having financial difficulties to go to CAB!!!!
Ive follwed it up with a letter which they will have received today, but wondered if anyone had heard anything from their banks re hardship cases!!!:mad:0 -
Yep i emailed them and also OFT, and they havent replied, that was a week ago!! they obviously too busy helping the banks get out of this mess!!!!!!!!!!!!!!!!!!!!!!!!!:mad:0

I have a claim with Lloyds which had court date of 12/9 with Southend court. Rang them today and have been told that judge has decided to stay the claim until after the test case. (Even though SC&M had advised me last week that claim would be continued due to me having a court date).
Anyway, I have had bloody awful last couple of years so think I would qualify for 'financial hardship' argument, but please if there is anybody that could help me with this I would be extremely grateful!
Cut very long story short, split up with partner last year, had loads of debts caused by him, and then found out I was pregnant. I had our 3rd child in April, repossessed in June, am on income support and have agreements of minimal payments to credit cards through Citizens Advice Bureau.
I have just had a settlement with Lloyds for £2,400 just before the OFT announcement, I have a 2nd claim with them for £4,000 which has just been stayed. This is the claim I would like help with if possible. (I also have an Abbey claim where had just sent 14 day letter to them, and also claims to do for Barclaycard and Cahoot).
I have had rough couple of years, and never ever been un this situation in my life. The bank charges are a way of me getting back my independence and a chance to clear some debts, rather than going bankrupt.
If there is a moderator, or anybody that can help me with this, I would be really grateful.

I'm claiming on two accounts, both amounting to about £2500. Already had offers totalling £1450. Rejected the offers and started court proceedings. Then this test case started!!!
I read in the emergency bulletins that if you are in financial hardship the case may still be heard in the county court.
Me and my family are struggling to make ends meet, I'm not going into too much detail but I was without a job in January of this year which means we're constantly playing catch-up with all our creditors, credit cards, we're so behind with payments it's untrue, we've even had our phone cut off.
We're currently getting help and advice from the Citizens Advice Bureau who are being really helpful because our situation is sooo bad!!!
It mentions in the emergency bulletin to contact the ombudsmen, who do I contact as I went through the courts? Do I still contact the ombudsmen or do I need to contact the court I'm going through? Or do I need to contact my bank and tell them of the situation?
Sorry this is abit long winded, any help would be appreciated.
