Currys PC world complaint - law broken and not correcting

I sent the below email to the CEO of currys pc world and they really are dismissing what has happened. They have broken the sells of goods act, as well as, advising a product incorrectly. I have also seeked advice and have asked that my complaint is sent to trading standards. Please give your views and advice on what my next steps could be.

Dear Mr James,

I am writing with great discuss at a purchase that took place at the curry's PC World in Sydenham, London - Branch 2856.

On 1st December 2014 I went into the store to buy a laptop for my son. We found a Toshiba C50 which was in the clearance for £279.99. We asked if we could buy it and was informed that due to it being on display they needed to reset it to the factory settings. I enquired how long this would take and was told an hour. With this information I agreed to return the next day as I was unable to wait the hour. This was agreed with the female manager of the store who's name I do not have.

I returned today (01/12/14 between 3.15-3.45pm) to buy the laptop. I looked for the young gentleman who had helped me prior to choice the laptop and explained it features. The young man ( his name is Edward) gained the laptop for myself and we went to the till. I paid the £279.99 and we went towards the door as Edward had to log some info about the laptop. All of a sudden a man in a suit, who did not introduce himself, came over and grabbed my purchased laptop saying I could not have it unless I gave him another £55.00 as it contains a USB, and without the USB I can not use the laptop. Edward tried to explained to this man ( who I later found out is named Ali Rahman) that I had brought it and everything was in the box and not the extra USB he had said was. The manager then opened up my box without permission. He then refused to give me my goods that I had paid for and belittle Edward by talking down to him about the laptop saying he had done the wrong thing, then turning to myself saying his only been here one day so does not know how to do it correctly. To this I was shocked. Not only had I personally seen Edward in there yesterday, so I'm aware he had not been there just one day, but the way in which Mr Rahman spoke down to Edward was highly disguising. Edward, the day prior, had also spoke to myself about his knowledge of computers however worked mainly on the TV section, so with all this info I was very aware that Mr Rahman was not telling the truth. I stated to Mr Rahman that I saw Edward yesterday, so how could he only of worked for one day today. Mr Rahman claimed all other time Edward was just training. Edward looked somewhat surprised by this statement.

I requested Mr Rahman give me my goods and to bring out the other manager as a customer can not be treated in this manner. I have brought the goods as advised and was told everything was contained in the box that I needed for it to work, as well as, I have paid in full. It was my property. He can not come along and take back my goods stating I can only have it from him if I give a extra £55.00. Mr Rahman refused to give me my goods or the receipt. I then went to look for the lady manager to get this sorted. Mr Rahman followed myself saying 'well if your not happy to pay then you can get a refund'. I stated clearly I'm not happy. I paid the displayed price in full and now your saying I cant have it and you have taken my paid for goods and your walking off with it. I don't even have the receipt. Mr Rahman then started saying that this is his store and he can do that. I told him that this is not his store. This is not true. I'm sure he does not own it. He then retraced saying well he has been given the store to manage. I told him that then he was lying as its not his store and he should not make out it is as I would like to complain. He then got very aggressive saying ' are you calling me a lair'. I stated to him it is a fact that he does not own the store therefore his statement of saying that it is his store and he can do what he wants is incorrect.

Not only am I disguised at the conduct and treatment, I am unhappy that I paid for an item as displayed and my goods was not handed over to me. If a customer came into the store and removed your goods without payment I 'm sure the police would of been called. Why does your manager feel he can take a customers paid goods and not allow the customer to have it unless more money is paid when the price did not reflect that an additional £55.00 was required, I was not told this at the point of sale, and there is no information stating that the laptop can not be used without the additional USB. I 'm sure this is not lawful to display a product in this manner, let alone keep hold of goods paid in full and demand additional payment.

Even if your manager owned the store I had paid for the item and all the contents in the box, therefore legally the item belonged to myself. Your manager had stolen my item and refused to return it to me.

My son is greatly upset as he saved this amount to buy this laptop and we have to return to buy it today.

I would like something done about this. Mr Rahman can not treat customers in this manner let alone hold on and demand additional payment for paid goods. I have no choice but to try and gain back my funds which the lady manager had to do via finding the purchase on the system as I had no proof of purchase as Mr Rahman would not give it to myself. Further Mr Rahman should not be allowed to talk to a member of the team in a belittling manner. Highly disguising that this young man was treated in this way.

My son would like the laptop and I really do not see any justification for adding on £55.00 after the point of sale, and without displaying the price at an additional £55.00. This is not lawful or correct in any way shape or form. We saw it for £279.99 ( I have picture evidence of the display, as well as, the refund receipt) and that is all we should have to pay for it with it in working order. The laptop display did not state it can not work without the USB and this is an additional £55.00. I would like what I paid for and Mr Rahman disciplined for his poor customer service and treatment of Edward. I would also like compensation for this highly disguising treatment, as well as, travel to the store as I had to return.

    The letter you have sent is too long. I doubt it has been read in full. You are right that ownership of the goods transferred to you at the point you paid for them though (unless you agreed otherwise, but that seems unlikely).

    So do you now have your money back?

    I think with PC World the USB is their "set up software" to set the laptop up which they normally sell as an add on.

  • What exactly does it setup? Is the laptop usable without it, or would you need to purchase/download an operating system?

    It could be the usb is not part of the sale but an item used to reset the laptop, it would have contained the operating system, but with the operating system installed it's not needed to run it.


    For me this was a mistake that the young lad made by leaving it in the box. The mistake was corrected by the manager but the op is having none of it.


    The product info would say what's included, my guess is that the USB is not included hence the confusion.


    I also assume the OP took the refund rather than just leave the USB but a link to the actual product would tell us for sure.

    Accodring ti the OP the manager would not let him have it without paying the £55 for the usb.

    Sounds like the USB is for the reinstall of the O/s

    Does your photo of the item and price says it comes with a USB stick?

    If not then they haven't done anything wrong.

    p.s. you should read what you write before you send it, it does not help your cases with so many spelling and grammatical errors.
