    They are still a private limited company and I would suspect that they are outside of the FOIA request area but if in doubt ask them under the FOIA and you will be certain that it is correct.

    Principally their overdraft charges on Personal Current Accounts.

  • Freedom of Information Act DOES NOT cover private limited companies and so they are exempt from it. What you are possibly looking at is if they have contracts with County Councils, Central government, NHS, or public bodies. Bank Charges are not covered under that mantra.

    In any case - this would be clearly commercially sensitive information. Having to disclose their costs to make them available to the competition simply wouldn't get near the starting gate.
  • Natweststaffmember please can you help me. My bank manager handed me over to collections when I claimed my bank charges to get me off her figures. I claimed under the hardship reclaim and on 22 Nov 2009 I got an offer which was dated 18th Nov. I signed it accepting the offer and posted it back. The very next day the court results came in. I thought that was luck I got it just in time.

    I phoned this morning to find out how my payout was going and the lady informed me she only recieived it yesterday! "Postal strike" she claimed was the problem. She says I have to wait and see if I will be paid since the court ruling!

    Surely as they made me a goodwill offer on the 18th and the fact that I accepted it means I will be paid out. Can you please guide me as my car has since failed its MOT and I cant afford to fix it and have had to put it onto SORN which means I have no transport and this payout was a absolute rlief considering they took over £410 from my account for 3 debit orders totaling £38.

    A hardship claim should be unaffected by the Supreme Court judgment - this is the positition of the Financial Ombudsman ''If you are in genuine financial hardship, this [the judgment] does not affect the legality of the charges'' http://www.financial-ombudsman.org.uk/faq/bank-charges.html
  • Hi, I am not sure what I can do now. I put a claim in to Abbey in excess of £3,000 which was initially rejected and then put on hold. Over £2,000 of charges were applied within two or three months when I was going through a relationship breakdown with whom I shared the account. To cut long story short, my ex partner of 8 years had not worked for over two years and at being at home most of the time enabled them to hide correspondence from the bank and attempt to apply for loans in joint names. I was unaware of mounting charges, increasing overdraft and missed mortgage payments, but, by luck more than judgement, managed to intercept proceedings just before the bank were about to take things further. I personally repaid all deficits, taking on three jobs and cleared debts on both bank account and mortgage. Unfortunately Abbey could not cancel any cheques that my ex had issued (without my knowledge) on the account so charges continued to mount. After a lot of hard work the account was brought to balance and closed. I took a loan, increased the mortgage buying my ex out and am gradually getting straight. I have two lodgers to get by and manage the interest only mortgage. I have checked and I do not qualify for hardship status. I still have debts of around £4,500. Can I still pursue Abbey for the refund?
