    The CEL example POPLA appeal from Feb is still fine as the basis for a draft, but start by saying you were an occupant of the car and you are the hirer (= the keeper under the POFA).

    The disability issue is certainly relevant albeit not something POPLA will even give a fig about (you are correct to mention it though because under the EA you are allowed a reasonable adjustment of time). Be careful NOT to say who was driving - I see your original appeal didn't, it just said 'we' and admitted you were among the party eating at Pizza Hut and that you are disabled.

    The NTK was posted too late for keeper (hirer) liability and the wording is not complaint with the POFA anyway (already covered in the POPLA appeal example).

    I would also complain to Pizza Hut Head Office! Or on their facebook page, not just locally. Spell out that this is indirect discrimination against disabled visitors who need longer to go about the same daily activities, and should be allowed a 'reasonable adjustment' of time.

  • Must be getting into the swing of things ... the time-limit bit was all my own work having read the schedule detail. I thought that's what it was stating but wasn't 100% sure. Fortunately right from the start I have been careful with the wording to avoid any incrimination of who was driving. It might seem a daft question (to the informed) but why haven't CEL etc included the PoFA 2012 wording in their notices? ps. almost starting to enjoy this!!

    CEL have never had a POFA - worded Notice to Keeper, probably because they had no idea how to. And because plenty of victims pay them anyway.

    Hi Coupon-mad, Just in case there is anything to note see parking notices that I have just received from Pizza Hut. We were parked in the same spot as the black hatch back, the bay just showing on the last image. It was just about dark when we arrived. Thank you

  • Find the Landowner, write and demand a exemption is granted under the Equality act as a genuine customer was disabled and unable to comply with the two hour limit.
    Ask them to inform the agents they employ of the granted exemption.
    State you are doing this as you are considering bringing legal action under the equality act but would like to offer them an opportunity to reactivity grant and exemption on this case as a good will gesture.
    I do Contracts, all day every day.

    You need to host them on a (free) image hosting site - PhotoBucket or Tinypic are often used - paste broken links using the URL (remove http from it); we'll do the conversion.
