Or they don't show up. You will need to show up though, and ignore anything you receive from CEL claiming that the hearing has been postponed or whatever, they are lying. Have your costs schedule ready, you should be able to get the thick end of £100 out of them.Je suis Charlie.0 -

In light of the Criminal case in Scotland where Civil Enforcemant are being prosecuted for operating a Fraudulanet Scheme, and 11 counts under the consumer contract regulations, it may be worth bringing this to the courts attention, and stating that you may wish to claim your costs back from the principal who took on Civil enforcement on their land which in this case is the Co-op as their is a real risk that Civil enforcement could go belly up in a few months

Here is what I advise, find as many cases as possible where they have failed to turn up.
I gather they are dozens, you will need case numbers and courts.
Prankster knows a dozen or so I gather.
have them listed ready in your sealed court bundle and if they fail to turn up at court pass the judge the list and request he looks at if this company are issuing vexatious cases.
Have your time you spent on the case listed at £18 per hour separately from general expenses such wages and travel.
Request that if the judge is to strike out the case he invokes the special circumstances for expenses as you have provided evidence of vexatious litigants failing to attend court repeatedly.
Request that the Judge allows your total expenses under the special circumstances rule.
Provide the list and do not spare the horses, all at £18 per hour.
People have got special circumstance payments before in county court, especially where the judge believes them to be acting vexatiously towards the courts.I do Contracts, all day every day.0 -

Who was it with then?
If cel were on the co ops land and their so called car park enforcement agents, then the co op as principal are equaly liable for their agents actions.
When clamping was around, often the only way to get your money back was by claiming against the principal- those who took the clampers on.From the Plain Language Commission:

I will gather some cases together and add them to my court file. £18 per hour sounds good although if I were to add up my research hours on this would run into the hundreds very quickly! I really hope they get stopped.
Does anyone have a link to the costs letter that was on here and then got removed? If not I'm sure il come across it! Thanks again0
