    Hello all, DEAL have called over the past couple of days to ask if I want to settle out of court.
    My answer is of course no but is this a good thing? i mean does it mean they are panicking? Do you think they will turn up in court?
    They did not serve me the questionnaire and so I wrote the letter to the court so fingers crossed it will get kicked out?

    Stop taking their calls seriously and look at the Parking Prankster's blog about the tricks CEL and DEAL play to try to pretend the hearing is off, when it's not. You MUST turn up if you have not been told by the actual Court that the hearing is vacated. Read the Prankster's info about this in his Blog, I can't link it from this PC.

  • Thanks for the replys everyone I will certainly be going back to CAB and showing them the evidence they were wrong!
    With my costs I know I should have that ready to give to the judge, does anyone have the link to the template for costs? I had it bookmarked but now it won't work for some reason?

    Thanks Coupon mad I never said I was taking them seriously I have read extensively about them and know they play silly games as you say! And I will certainly turn up in court completely prepared and ready to do battle unless I have an official court document stating otherwise which I would check with the court was official before believeing even that! Haha 😃

    Thank you again I know you must tire of saying the same things again and again but it really does make a difference to hear it personally to me 😃😃

    hi folks, sorry for jumping onto this thread but i need some advice regarding CEL & a CCJ received from Debt Enforcement & Action LTD, I'm brand new to forums so not too clued up what I'm actually doing so please bear with me.
    Any sound advice appreciated..........
    My wife received a charge through the post for overstaying in a free to park CEL carpark. We chose to ignore the letters as advised or different websites and forums and the last letter looked like a photocopy CCJ letter without any court stamps and we passed it off as scare mongering from CEL.
    Today we received another photocopy of a CCJ default judgement against my wife but this one had a stamp seal from the court on it. I phoned the number on the paperwork and asked if this was actually i "real" CCJ??
    I was informed it WAS and judgement had been passed in default!!
    After speaking with the courts by phone i was advised that i can submit a N244 application form to have the default judgement "set aside" and then i may have the opportunity to allow us to have our say and submit our defence and try to get rid of CEL's ridiculous £130 charges for over staying in a free car park.
    Trouble is we don't really have much of a defence as we did overstay, due to car issues (typical Renault) and was wondering if its worth fighting this now? is there a chance that we could lose if we chose to submit our defence and challenge their extortionate charges? or are we better to get rid of this CCJ by paying the judgement figure which now stands at a whopping £237.00 which i really don't want to pay if theres any other option?

    You would need a good reason for the court to set this aside - ignoring court papers previously sent doesn't sound that good a reason. You will have to pay £155 for the 'pleasure' - which won't be refunded if the court does not set aside AND you will also have to pay the judgment amount of £237 on top.

    Even if you get a set aside, you will have to carefully craft and produce your defence and present it at court. It won't be a case of just rocking up and letting fly to the Judge about how unfair this charge was (even though it was!).

    In my view, you need to pay the court judgment asap or you will get a CCJ, and your credit standing is likely to be shot.

    You may have to put this down to (expensive) experience to remind you not to ignore a parking charge and NEVER ignore court papers.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    My apologies for the late reply - the case had unfortunately been incorrectly allocated.

    Civil Enforcment Ltd did have the contract to manage a number of our car parks. Due to this, the collection of monies was their responsibility. After listening to customer feedback, changes have been made to our car park management system. As of December 20th 2014, Civil Enforcement Ltd are no longer responsible for our car park management. However, legally, they can continue to claim for payments due which were received prior to this date.

    Unfortunately, we are unable to comment further on business sensitive issues. I am sorry that I could not be of any further assistance.

  • I have received my court date letter :( which means even though i sent the court the letter about striking it out they haven't!

    Is it true they iusually don't pay the £25 court fee and therefore gets struck out?
