Sorry if this is wrong post.
I have hearing tomorrow for removal of stay, does anyone know what kind of questions will be asked and if any papaerwork will be needed.

You will need to explain why the stay should be removed. If you take along three copies of the document on this link http://www.oft.gov.uk/shared_oft/business_leaflets/general/PCA-particulars-of-claim.pdf you can argue in addition to what you were going to argue that the limited scope of the OFT case means that a stay is not justified as not all the issues are going to be dealt with.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -

Thanks, have got this document and argument, found on earlier post, thank you. Don't mean to sound stupid, but can you just explain a little about which issues it doesn't cover, say if the judge asks me what issues it doesn't cover and i am just sat there open mouthed, lost for words.
In my case a lot of Halifax defence is based on the fact i received a payment on this account for different dates/charges therefore can't claim anything else, never signed anything to say this and i do have proof i've not signed anything to this effect.
Do i use this when asked what issues?

I just thought I would let all the Cardiff claimants know that my application for removal of the Stay based on financial hardship (I am unemployed and on benefits) was REFUSED.
I received notification of this fact this very morning in a letter from Cardiff County Court. I suspect that many of you will be receiving letters from today onwards. Hopefully at least some of you might have better luck, but I somehow doubt it.
The Judges at Cardiff County Court are definitely not on the side of the consumer and it looks as though we have no recourse but to wait.
Unfortunately, waiting is not something I will be able to do as I now face financial freefall. But it was a good fight while it lasted.
I wish everyone all the best in their endeavours, but (thanks to the OFT) my fight is now over as even if the OFT win the case against the banks next year, it will be far too late for me.Reclaims in progress:

Please can someone tell me whether i should still go ahead and claim the charges from the bank or just wait it out? I'm confused. I am still waiting on my bank statements being sent to me and am just wondering whether i should bother to proceed when i receive them given recent developements.

Apologies if this has been discussed before but I would like to know as the bank charge reclaims have been put on hold why then have the bank charges not also been put on hold? I am still being charged several charges every month and this can't be on surely???0 -

Please don't give up now, get everything together and send it off to the FO and see if they will take it on. I certainly isn't a speedy option but you have nothing to lose and could be everything to gain if they will take it on.0 -

Its up to you but if you start your claim now it stops charges from 6 years ago being time barred...

My understanding of this whole situation is that the FO will not touch a case that has gone through the court process - stayed or not.
