    Sorry to add to the list but me too - Barclays and Nrock. I wrote off after the 27 July 07 OFT announcement. Got letters back saying to was going to the high court and they would not action any claim until the outcome of the hearing. Do we go to MCOL next or send them a 2nd letter asking them to "cough up some green" ?
  • hi, I,ve just registered and need to ask a question.
    I've just received a letter from the court saying that the defence was struck out and that i can requst a judgement in default and the hearing be vacated. What does this mean and what do I do now? :confused: Does this mean that the bank now has to pay up:question: :confused::confused:

    All,

    I was just thinking and please forgive me for sounding all legal when I am not fro that realm... Hasn't the fact that the courts have already been ruling in favour of the customer set the 'Legal' precedence to allow claims to continue (regardless of the OFT announcement)? Do we have a legal expert who can comment on this? I am only a mere mortal with 'grand' designs ;-)

    Unfortuantely all the previous decisions have been by County Court Judges and are only persuasive at best and do not bind other courts not even other county courts. What we need is for a matter to go on appeal to the High Court for a binding decision. The banks for some reason do not seem to want a decision on appeal
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • Had a notice of transfer to my local court for my claim against Barclaycard, then a letter saying it had been stayed, rang the court to get this removed and she told me it wasnt worth it now and id have to pay £65 to get it removed along with a very good case to do this, i also enquired as to wether this stay was only on bank charges and she said it was also happening with credit card reclaims as they were being treated the same.
  • Just wondering about the fee we have all paid to MCOL.
    I, like many others, have paid £120 to take Nationwide to court, as there is now a stay on pretty much all cases, are we entilted to claim this money back????:confused:
    It seems a pointless to pay this fee for them to do nothing!
    Anyone have any idea's???

  • Hi stokey & Jester still have not heard a thing from the court, I have sent another letter to them and again to Rhodri ( The Right Honourable) and also to the Master of Rolls again, see what that does The only response was from my MP with a letter from FSA and I have replied to that !! (sorry if I am repeating myself, but I think my brain is haggled now ! and I need a holiday from this! but then I'M NOT A JUDGE))

    The same as happened to me, and i am not happy.

    Before submitting via MCOL, i asked the OFT, FSA and FOS, if credit cards were affected. No they said, so i filed as at court. It was immediately stayed.

    The court say its up to a judge to decide, and not the OFT, FSA or FOS. I have today filed a complaint to the court, and will be complaining further regarding the judge.

    Thing is now, i would like my case cancelled, my money back, and then to go the FOS route, as they are still dealing with credit cards.

  • Sorry if this is wrong post.

    I have hearing tomorrow for removal of stay, does anyone know what kind of questions will be asked and if any papaerwork will be needed.
