Ok, I have read a lot of threads on here and am at the stage where I have to take the bank to court! I was going to do this today but am now unsure whether there is any point. I know there is a lot of information on here but just to simplify it as it is all quite bewildering (and I have baby brain - 34 weeks pregnant!)
I have new charges added to my account monthly which I need to keep adding and need to get out of this sinking mud!!
Should I still go through with my court case today or shall I wait? ...Angel

Natwest say the case will take about a year.
A year, just to decide if the unfair conracts regulations apply.

It's just heresay that it will take that long. You are right, how many words can they use ???
One could think that all this is pre-planned and all this will come to a head.

Think I might write to Barclays and tell them I won't be paying my mortgage until my court case is resolved and they come up with a decent explanation as to how I lost £5000 in eleven policies they sold me. Also need to know what they want me to do about the account (was zero balance) they closed in February yet are still adding a £10 a month charge plus interest.
The situation is as previously mentioned......they do what the hell they want and we have no way to fight back.0 -

Silly question that may have been asked before #239 : Does this apply to ALL claims or just banks? I submitted claims to NatWest and MBNA yesterday (grr) and am wondering whether I'm right in thinking I should just forget about it for the foreseeable future or whether credit cards are different.

I sent the court claim to my bank on 18/07/07 it cost me £120 which I can't afford (I am trying to get back £1300) it said it would be deemed to be served on 24/07/07.What happens next considering the latest developments.0

From what i see, banks will not argue that the charge is a true reflection of cost, but instead they will be saying that it is an agreed payment for a service and it is not regulated by the law.
it will come down to T&C and Lord's interpritation of those.
My best guess - charges will be rulled unfair, but only in the past. After the decision those charges will be allowed under new T&C. And they will not auto-refund anyone.0 -
