OFT and Banks to decide on "fair charge"

    I'm in the middle of a £1700 claim against Barclays. I received an offer of £863 (goodwill getsure) on the 15th June and have 8 weeks from that date to accept or not. In the meantime Barclays have defended my court claim and it has been transferred to my local court although I have yet to receive a date.

    I guess I'll hold out until next week when Martin's e-mail comes round answering all of the queries raised on here before deciding what to do.

    At the moment i'm veering towards accepting the offer as nobody really knows what the final judgement will be and how long it will take.

    we're in the middle of barcleys claim that they are defending!!! we have a date! 9th october! whats gonna happen to that??
    is there anyway to help the oft push it our way eg letters etc???

    ggggggggggrrrrrhhhhhhhh!! not happy!


    with this do we get our £120 back???

  • I first posed the question last night regarding the banks still being able to charge customers the fees we are all trying to claim back, I again ask surely they should be stopped from charging us if they are suspending all claims!!

    I also strongly agree that the government would be foolish to ignore the weight of opinion on this and other sites, as would the OFT.

    Lets get their attention and all e-mail the OFT, if everyone sent them their concerns and views over the weekend then come monday :eek: :eek: :eek: one nice surprise of public feeling.

    The banks will try and claim each time anyone goes over their overdraft etc, they have someone look at that persons account and credit score it, or so said that stupid woman on GMTV pre 7am today. Really, I say, then why is each letter I recieve from them exactly the same, except for the date!
    Automatic letters triggered by someone going overdrawn I think.

    Anyway, we all need to stick together, and push the OFT into doing this properly, and with help from the god that is Martin Lewis:money: we still can succeed.

  • I think that Martin said that if the charges were deemed unlawful and the banks had to refund all charges, without request from the customer, the amount refunded would total £10,000,000,000. The banks will fight that tooth and nail.
    The only reason this has happened, is down to one issue that the banks have realized this is going to cost billions to repay what is owed.

    The mention of banks having to repay back excessive amounts of money to customers who have been unfairly charged, should not come into the equation seen as they were quick enough to take our money in the first place, so they are not outlaying money from their own pockets but from the pockets of which were lined by all the customers unfairly charged.

    Please note, for anyone who didn't catch Martin on Ch4, he only heard about this 1/2 hour before going on air and I've no doubt he will post something once he knows what is happening.

    I appreciate that Martin needs to get up to speed but in his first comment he says NOT RE this does not apply to Credit cards but Banks
    i haver a Cap one going through MCOL nearly at completion and was about tostart a claim for Barclaycard Visa for £900 Thyenhave credited £ 360 inthe hope that I'd settle. I am concerned that if I start MCOl on Monday and shell out £120 Will the court staff think that the suspension applies to credit cards as well. Any thoughts

    No it's ok - this does not affect credit card claims at all. Bank charges are separate to credit card charges, you may proceed as normal :D

    hi i was wondering if anyone can give advice to me???
    i had until the 21 july to give details of charges in dispute and why i feel they were wrong to the courts and D&G solicitors (HSBC) and then they had until 22/8/07 to reply as to why they were lawfull and to give a breakdown of how they reach the charges.
    i had heard that they were settling before the deadline date as they do not want to disclose these
    would this new ruling not put a stop to this or am i fear enough down the road for it to continue?
    like everyone else just feeling totally deflated at the moment as i thought i was so close to getting the money back and then this
    cheers for any advice that can be given

    I started court proceedings the night before last. Can someone pls advise me on what I should do. I am in the 14 day waiting period and if I do not receive a response I should win the case by default. Does anybody know where I stand with this?
