I found myself in this dilemma a few months ago and decided to seek advice from HR. Unfortunately my employer decided the money should go to them (even though the delay in question was outside of my contracted working hours). I'm still kicking myself for bringing it up with them!0

Perhaps you should print off the relevant section of the reg and hand it to your employer - who may have paid for the flight but did not suffer the delay and inconvenience.

I emailed them a copy of the legislation and was met with the response-it was a business trip, we paid for it and even when I pointed out that was irrelevant they weren't interested! I'd only been with the company 6 months at the time so didn't push it any further0

Still there, so don't want to rock the boat too much! I've still not been shown anything in writing that states they were entitled to the money. It seemed to have been decided off the cuff by the HR manager and was worried about escalating the matter much further.
I'm not expecting I'll ever see the money again, but I guess I wanted this to be a cautionary tale to people, if I was in the same situation again I either wouldn't claim in the first place or wouldn't tell them about it!0
