Hiya, a quick question to the oracle that is the elite.
I was rearended today, I have a whiplash injury and my car is drivable but damaged. Other person has taken full responsibility.
Should I claim through my insurance or theirs?
I have spoken to mine who will see about fixing the car but not the neck injury as I didnt take out legal cover.
The other person is talking to their insurer right now and Im waiting for a call from them. Will they take the neck injury on board?Love your Mum, you'll never get another one when she's gone.0 -

Don't know about the neck injury, but you have to report this to your insurance company anyway, or your insurance will become void. Perhaps that's a little strong, if they find you have had an accident and not told them then they may well not pay out on any future claim. They in turn claim through the other person's insurance. Often people go back on what they say immediately after a smash, but normally if someone goes into the back of you it is their fault for not leaving enough space anyway whatever they say.

I have been to hospital and also have a police incident no.
I have spoken to my insurance and they will fix my car with no penalty on my NCB. But not the injury.
They have left it with me to choose, my insurance or theirs?Love your Mum, you'll never get another one when she's gone.0
