There is a simple solution to the argument of whether whatever is 'enforceable' or not.

The solution is, if one receives a ticket, to have one's day in Court......Present one's arguments as a Defence, and see what happens?

That much, everyone is entitled to do.

And when the Court Clerk corrects you and tells you they can park there and asks what you intend to use in your defence, what do you suggest then?
  • A plea of insanity.

    Heh heh! :)

Well, for starters, it rather settles the argument.....[exploding yet more urban myth?].....
No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    What crime would that be?

last time I checked civil servants (safety partnership is not manned by police officers) cannot gather evidence of crimes, they can man camera's for minor traffic offences but are responsible for where and how they park!.

The camera vans usually have " working in conjunction with the so and so police" , they are not the police, not run by the police and have no more rights than you and I. If a mobile speed camera van is parked illegally then it is operating outside the law and cannot legally enforce tickets(they need a closure certificate to operate parked on the verge or pavement just like a builder would to obstruct the public highway in the course of his work)There needs to be a police officer present to witness the crime to make it enforceable which there never usually is otherwise we could all buy a van and speed camera and dish out tickets to people as we see fit ! People get confused as Gatso cameras and motorway gantry cameras operate under a different section of the law and can enforce payment without an officer being present , it's not the same rules as for a council official in a transit van who happens to have the word " police" on the vehicle. There is a spot near me where there is a little laybay they operate from which has a sign stating "police vehicles only" attached to it. The vehicles that park there with cameras are council vehicles so are in fact operating illegally as all police vehicles are crown vehicles and do not need road tax as are ambulances and the ones I used to drive for the blood transfusion service
Why do people just make this stuff up and state it like its true?

Its not his/her job to do such, he/she is a clerk not a judge the magistrate etc decides of material of facts, although some are qualified legally, they are not there offer services in overseeing your defense case.
  • Its not his/her job to do such, he/she is a clerk not a judge.

It's their job to advise magistrates on legal matters.

Are you going to answer the question asked of you or do the decent thing and admit you made it up?
