  • reset to factory settings might work - but I don't know if that needs a password to do

No, there is no way around this and is a security measure to stop the sale of stolen phones, it can only be turned off by the owner of the icloud account it is activated to.

If a phone is legitimately purchased then there should be no issue getting the seller to deactivate it from their account

Restoring it will make no difference

IIRC restoring it will make it unusable without the icloud password

Correct, a restore will require the icloud password to get past the activation lock

Unfortunately then you have an expensive paperweight.

I wasn't suggesting you didn't buy it legitimately but it sounds like the person who you bought it from knew exactly what they were doing if you now cannot get hold of them.

If the seller was legit how come you can't get in contact? Surely you must have gone around to their address to buy the phone? Phoned or emailed them to make the arrangements?

If you didn't and bought it in a pub car park (for example), was it really legit in the first place?

It's a paperweight until you get the previous owner to remove their iCloud...

  • Is there really nothing that can be done at all. can't apple reset it.
  • They could, but they won't without substantial proof the phone has not been stolen.

nothing can be done, it's an anti theft measure so Apple won't help either.
