if he alleges you brake checked him, following the revelations you have just given in your previous post, frankly I wouldn't touch your claim as you largely sound like you were the author of your own misfortune and your credibility in denying you had caused or contributed towards the final "incident" will be on the floor.
Good point about tit for tat. You are right. I reacted badly and I have some responsibility to assume for the incident. I agree with that. However, I think it’s a bit extreme that over taking someone effectively gives him the right to plough into your car.
He can allege that I brake tested him but there are two independent witnesses that will say otherwise. I guess that doesn't matter to the insurance companies as there was road rage and we are both at fault. I still find that crazy. Essentially, people can just ram into your car, say you cut them up/overtook them, and get away with it because of road rage.
No wonder all these idiots tailgate bumpers so closely. No one has ever become poor by giving0 -
So have you contacted the TP insurer yet because you're not going to find out whether the other driver disputes liability until you do so and get the ball rolling.0

Oh, the irony.0 -
Personally I'd just go with the independent witnesses and deny all the rest.
He ran out of skill during this incident. Loser.0 -

Well, when I overtake someone on a dual carriwageway and they accelerate to hold me out in the LH lane because it merges in 0.5miles time, what gives them the right to try to kill me?
The fact is, too many people drive about trying to Police their own version of the highway code, just looking for trouble.
I think they do it because they know they are incompetent and are trying to make somebody else look bad.
Nothing gives any of us the right to drive like we own the road, so if someone is driving like an idiot just get out of their way asap.
"Right" goes out the window when the red mist descends.
IMO, your lucky it wasn't some meat head in a Nissan Navara. Those guys are like the 1971 movie "Duel", I swear i've had 3-4 of these things try to kill me just for overtaking them.“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”
