In that case I'd go directly to the other guy's insurance. With 2 independent witnesses it should be pretty clear-cut. ( You're right, your girlfriend would not be classed as independent ).0

Sounds like you've got an excellent case. I think I'd contact his insurer in the first instance like you say and see if they'll deal with you. It'll work out cheaper for them in the long run to deal directly with you I think so makes sense that they would do it. If not, a credit hire company is the place to start, you claiming through your insurer would be the last resort.

If you have 2 independent witnesses then go for number 3, by far the quickest and cleanest.....make the most of it, we are only here for the weekend.

1) isnt out, its a simple letter you have to write with a photocopy of your receipt of paying your excess or letter from your insurer showing the excess was deducted if its a total loss.
Claiming directly from the TPI is certainly the best option, assuming you havent started anything with your own insurer other than reporting it, but just because they will be liable based on witnesses etc that wont mean they will roll over instantly to admit it and if you are worried about recovering your excess then negotiating liability is certainly more challenging than that.0 -

It was night (by your own admission), it happened behind you and he sped off. You'd have had a fraction of a second to look at the driver and even if it were daylight, that probably wouldn't have been enough time to get a look at him.
Was this accident the culmination of a series of events with this person?

I started a claim with my insurance company as I thought that's what I was supposed to do. I have given them all the information but since then I have e-mailed them to inform them that I will be claiming directly from the third party.No one has ever become poor by giving0 -

He came out of the car and gave me some abuse. I got to see the driver very clearly and asked him three times for his insurance details. I would be able to recognise him. The accident occured after a series of events but I have given the police all the information.No one has ever become poor by giving0 -
It wasn't him, he wasn't there, the plate was cloned, you wrote it down wrongly, his car was at the garage...
I can recognise the driver and so can two independent witnesses, the plate matches the make, model, and colour of the car I described. There is CCTV on the roundabout before the incident. I really can't see how he can wriggle out of this one.No one has ever become poor by giving0
