  • I find it interesting that some stays are starting to be lifted, but none that I've read so far involve Jet2, it would appear to be taking far too long, for what should be a straight forward decision based upon the SC ruling.

  • my case against jet2 stayed since last year, after supreme court verdict. wrote to county court requesting stay was lift. received reply from court yesterday say stay has been lifted and a hearing date 21st march 2015. bring it on 2birds. can't wait.:D

    Brilliant news, it's looking like the dam is starting to crack! Well maybe, okay... hopefully.

    I would think that a few other cases would have been heard by the time you get your day in court, which will give you an indication of what to expect.

    Pressure is now building on courts all around the country to release the backlog of stayed cases that have built up due to Jet2.

    Let's hope so, I'm 50/50 if it will get that far, the common sense, decent thing to do would be to now 'gracefully' accept defeat. I think tonight can be summed up by a post of mine in the J2 thread

    when I phoned the court up last week for an update has had heard nothing from 2 birds or the court, and was told that 2birds had requested take the stayed be lifted. court hearing is at scarborough county court

    This didn't make sense, why would 2birds ask for the stay to be lifted in your case and vehemently continue to delay others?

    I think I've found the answer:

    So your case appears to have been stayed because of Dawson?

    They've thrown all sorts of guff in there, It looks like Centipede responded fully, but because of the vanishing posts issue, it's not clear what the advice was, we all know that weather is an EC, but centipede appears to say that your flight was cancelled not delayed....

    Off to re- read it all again back soon - it appears that the delay was to a previous flight and you were bussed to Manchester, because The plane was in the wrong location?

    It still doesn't make sense. If the Dawson limitation was the only defence in this case then why not settle? You don't go to court if you know for certain you're going to get spanked!

    As far as I can make out, J2 are using EC's due to the weather and fire. Albeit weather on a previous flight. They also say that they couldn't re-locate the aircraft to LBA from MAN that morning also because of continuing weather problems. I read Mark2Sparks post about this senario http://forums.moneysavingexpert.com/showpost.php?p=59429463&postcount=580

    Maybe they were hoping that if the Dawson appeal was successful the case could be chucked out because of the time element, since that failed, they want to fight the case fully on an EC issue that is not related to Huzar or even Van der Lans. The EC issue of weather in this case is not a 100% certain defence - looks a bit of a gamble to me.
