Just a quick post to ask if any of you good people would be willing to give me some helpful advice regarding my stayed case for a flight delay group compensation claim.

Do I contact T C directly requesting them to reconsider their position on a claim I made in June 2013...

....Or am I best contacting my local court requesting that they reopen the case in the light of the recent judgement made by the Supreme Court?

Any feedback or suggestions at this time would be greatly appreciated.

    Thanks

Thomson Airways, Stoke on Trent County Court. Stayed pending Dawson. Wrote to the court asking for the stay to be lifted and received the following reply. ''District Judge awaiting reply from the solicitors for the defendant as to the updates regarding appeals.''

Why does he need to wait for that? Surely the fact that you, the claimant, has informed him that both appeals were thrown out is enough?

  • Hi all,

My case is currently still stayed against thomson pending huzar at kingston county court. I have written to both the court and thomson asking for the stay to be lifted, no communication received as yet . . . . . .
  • Jet2 at Mansfield CC originally stayed due to outcome of Jet2 v Huzar, now Bird & Bird requesting further stay due to van der Lans v KLM. I guess we must wait until the system is finally exhausted as to take these cases on individually would be a silly option in my opinion due to the possible cost involved in doing so should you be unsuccessful.

Have you read the Huzar thread? https://forums.moneysavingexpert.com/discussion/4815669 General suggestion is that you write to the court not agreeing to the stay requested by Jet2 and asking for the case to be heard asap. Don't let the airline take control and delay even further.

Not only what JPears says, the dutch case is nothing to do with UK law and as already been used in the Jet2.com Supreme Court submission and lost.

  • I only heard that the birds have requested the klm stay yesterday. I note several poeple are contesting these stays already including Bott and Co. As I have not heard anything from the court at Mansfield directly yet I feel the sensible thing to do would be to wait a little while longer to see if the straws that Jet2 are clutching to have any strength. Hopefully the house of cards will soon come tumbling down on Jet2 and their avenues of attempted escape blocked off totally.
