Fine for parking in parent & child bay - delivered to home 24 hours later

  • I called UK CPS LTD today and spoke to Peter the Manager. He assures me there is signage on the premises which says that to park in a P & C bay you have to have a child under 12 with you. He says that it is law as it is a law in the contract law decided upon by the owner. I asked if maybe it could only be interpreted as an "Expressed wish or desire" and he said NO. People who own private property and let the public park on them can write their own laws.

That seems pretty valid if you dont want people filling the space for 9 hours while they commute to work and prevent shopping customers access to the shop.

Or parking in disabled bays preventing disable people access to the shop.

But P & C bays, last time I checked having kids was not a disability and I should know - I have 5 (2 own - 3 step). It may be an inconvenience but its not a disability ...

    Why did you ring them?

Why did you not follow the advice given to read the NEWBIES thread?

Why, oh why did you call UKCPS? Mr Haswell is only going to tell you what best suits him to say.

Have you read the Newbies sticky yet? If you haven't I hope that you did not identify yourself to Mr H or you can expect an increase in correspondence from him.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

"Loads of accessible parking" but you park in a child & parent bay?

Why not? P and C bays have absolutely no meaning or standing whatsoever in either civil or criminal law.

Having spaces marked for "Green Cars Only" would be just as legally binding and equally ludicrous.

They are a gimmic from shops in the hope they will attract additional custom. Unfortunately parking comapnies use them to generate more income and drive customers away which is completely the reverse of what the shopkeepers want.

That is absolute cobblers. In fact I would go as far as to say it is a lie. It is not the law by any stretch of the imagination.

You have been foolhardy in contacting the PPC when advised not to, and to make matters worse you are now believing the lies spouted by this company.

Please, please read the NEWBIES thread and follow the advice there. You are only making things worse otherwise.

We all know Haswell's shaky knowledge of the law. In one court case he tried quoting various traffic laws only to be slapped down by the judge.

Although you are obviously lazy and inconsiderate you have no need to pay any PPC money, however perhaps in future you might be more considerate of others.

And buy a waterproof jacket :D

    - 'obviously lazy and inconsiderate', and you are what by contrast?

As c-m repeats on these Threads, p+c spaces are a marketing scam, nothing more.

In future, offer to carry the 25kg sacks for op.

This is exactly the sort of response that sends people away from mse and runs against Martin's enjoinder: 'Please be nice to all moneysavers.'

So I can ignore any P & C, or Disabled Bay signs, & will 100% be able to ignore any tickets?
