Fine for parking in parent & child bay - delivered to home 24 hours later

Please help!

I have been reading all the posts relating to UK CPS LTD.

I received a PCN for parking in a PARENT AND CHILD BAY, and I dont have a child. It was raining and I was in the store for 20 minutes. The parking is free for up to 2 hours.

Since when did it become illegal to park in a Parent and Child bay if you dont have children with you or a child seat in the car?

This is just a scam and considering its a fairly poor town one would think they would encourage all the support for business they could get?

Should I wait for the letters to flow in the door or should I start contesting straight away. I cant seem to find any by-law that states that its illegal to park in a Parent and child bay. Its not technically the same as a Disabled Bay.

The PCN was not left on my car at the time of the incident. It was posted onto the windscreen overnight on Saturday night which means they have already obtained the information about my car from the DVLA before the 28 days are up.

Surely this is illegal?

Any advice appreciated

    It isn't illegal and you have not been fined!

    Because there isn't one!
    Read the newbies thread on page one of this forum and follow the advice, might help if you state who the PPC is too.

    I concur with Fisherjim.

    But I'm more interested in the fact they tracked you down to your home address to give you a windscreen ticket. First time I've heard of that and seems above and beyond the call of duty for the parking attendant.

    OP, do you live close to the store?

    Confused. Are you saying that someone has hand-delivered it onto your windscreen after the event? Does it have your address written on it? Or have you just been followed?
    Surely this is illegal?
    What criminal law do you think has been broken?

    What? Not possible, surely.

    I would send a quick email to:

    [EMAIL="foi@dvla.gsi.gov.uk"]foi@dvla.gsi.gov.uk[/EMAIL]

    and say you are the registered keeper of the above vehicle (obviously give your full name, postal address and car reg!) and you are NOT asking for keeper's details and will not be paying a fee. What you want to know is, have UKCPS obtained your data in the last 90 days and is so, when, and if so, what date of parking incident was given? Say you suspect them of obtaining data before the 28 days was up and as such they must treat this enquiry as a formal complaint, if the DVLA released your data without reasonable cause.

  • The ticket wasnt on the window when I left the store as it was raining and I would have noticed that the wiper would have been hampered as we found it this morning stuck above the window wiper.

    It was raining on my journey home so I used the wipers.

    I am worried they obtained the information on my vehicle from the DVLA or from other websites (insurance etc who sell your information). This is what confuses me as they found where I live. I live about 10 miles from the store and they stuck the fine on the window overnight.

    What happens if the fine blew off in the night?

    The other thing is the fine was written so illegibly and pale it took about 20 minutes to decipher.

    I think they have access to the DVLA database or some other database sold to 3rd parties with your information and believe the fine was hand delivered in the night.

    I live about 10 miles from the store.

  • I phoned the store to find out if they were aware of this happening to customers and they said they had numerous complaints. This surely cannot be good for business.

    Its not a crime to park for 20 minutes in a Parent / Child bay and no one was inconvenienced as the parking lot was like a ghost town with loads of accessible parking.

    I will go back and have a look at the sign but it will be interesting if it states that car parked in P & C bays without children on board will be fined.

    No wonder small independent retailers are going out of business and town centers are rows of empty boarded up shops - parking cowboys are killing their business. I certainly wont bother going back to that center to shop - its easier to get it on-line. Sorry folks, you rent the property - you should manage the options on your parking.

    No it doesn't say 'fined' - this is not a fine and is EASY to beat on appeal in the end. Send the email to the DVLA and let us know what they say - UKCPS cannot get your address from the DVLA this early, not by any other means so something isn't right.

    You will of course know, having read the 'NEWBIES read these FAQs first' thread, before posting, that you have plenty of time before you need to challenge the charge (only appeal as keeper - not driver - next month when the NTK arrives in the post). As per the sticky thread advice.

    So for now just ask the DVLA the question, I reckon they'll say UKPCS hasn't obtained your data yet. I reckon the PCN was there all the time.
