Exceeds marked bay area - does it? (Pics)

Hi,

I have received a parking charge for £100 from Premier Parking Solutions for Exceeding Marked Bay Area. I've attached the photos they have sent:

As far as I can see:
1) My wheels are all within the marked bay area.
2) The front of my car is aligned with the front white markings.
3) The parking bay is on a corner, if I'd parked further forward there was the danger that other cars turning could damage my vehicle.

I'm intending to appeal to PPS directly first, and then to IAS, highlighting the points above, does anyone have any advice which would help?

    Yes, you will lose. Read the Newbies sticky and appeal as described there.

    Interesting to read your reply, why do you feel the OP will lose? I would agree with the OP's thought's that the wheels are within the lines, yes there is over hang on the luggage area.

    There was an article on the radio this moring about PCN's and their validity or lack of validity.

    They will lose because "mitigating circumstances" don't count regarding eithe PPCs or POPLA. What you have to hit them with is no genuine pre-estimate of loss or lack of contract. I know it sounds weird , but that's how you have top play this twisted game.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Surely the lines are meant to contain the whole car not just the wheels. The OP's car is preventing at least 2 other cars from being within their spaces properly, possibly ridking them getting damaged.

    OP, buy a smaller car or learn to park properly!

    Because this is a PPC we're talking about; it's normal for a PPC to reject appeals as they just want the money. And IAS appeals seem to be almost pointless too.

    I don't "feel" he will lose, I know he will lose if he makes that his only appeal point. Whether he is in the right or not is irrelevant, the appeals service is purely about legal technicalities, they're not interested in facts.

    We know all about Michael Green's campaign and the piece on the radio this morning thank you.

    It's Premier so it's PoPLA and there is every point in appealing - just not on that single point.

    You can get out of paying the ticket OP but to be fair to others in the car park you need to learn to park.
  • Ok, so what I'm gathering is that:

    1) Cars have parked in all the surrounding spaces and so I haven't caused them financial loss.
    2) The space isn't big enough for my car, I paid for a parking space and was supplied one too small. Either the parking spaces are too small or BMW need to reclassify their vehicles.

    I realise my parking isn't fantastic here, but I don't think its £100 bad.

    I don't know about who it was, I was listening to BBC WM, when I asked why do you feel? , I was not challenging your judgement, was genuinely interested in the defence terms.
