Reason sellers were moving and noisy neighbours - update

We've been iin our house for a couple of months and have been having problems with our neighbours. When we looked around the house the second time, we asked what the neighbours were like. The sellers told us that they had had a couple of problems with the next door neighbours (it's an end of terrace) - mainly loud music. They had a few mediation sessions and everything was fine and they 'had not had any problems for 6 months'.

From our experiences now, we feel that they weren't entirely honest with us and certainly why they were moving - I think they were moving because of the next door neighbours. We were given the impression that any problem had been sorted and all was fine, no worries.

Where do we stand on this?

    I believe that your solicitors will have sent a list of questions to the vendor one of which will have about disputes with neighbours. If they have lied then consider suing

  • Did your vendors put the complaint in writing to the council? If they didn't, then I don't think you can sue them.

    Having said this, if my vendors had told me that they had problems with music but it was sorted, alarm bells would have started ringing and I would have walked away.

    don't mean to state the bleedin' obvious, but have you had a word with the neighbours? If that's a no-go and you're going mad and thinking of selling yourselves, be careful that you don't escalate the dispute to such an extent that you put the next lot of victims, er, buyers off. Hopefully if they are aware of the problem they are causing they may modify their behaviour....you never know, worth a try. There's soundproofing otherwise - someone I know got in an acoustician for a paid quotation, he did a full plan and they then got an ordinary builder to implement it and he's reasonably happy.

    Maybe they told you the truth when they said they hadn't had any problems for 6 months. Maybe the noisy neighbours realise they have new neighbours and are trying their luck again :confused:

    Apart from the fact that you were warned? :o

    We bought a house with a 'wife-beater' next door and then heard that our vendor 'loved that house - the only reason she moved was because of them'. Our solicitor advised the best thing we could do was to get shot of the house; that suing would be a pointless and costly excercise.

    They sold and moved on before we sold thankfully, so I never had to deal with my conscience.

    We also got caught living next door to the woman from hell!
    The sellers of our house said they got "a bit of noise" now and again from the other side. The house next door was split into 2 flats so the living room of the upstairs flat was our bedroom. The woman had a liking for nightclubs and then inviting the world home with her at silly o'clock. This went on for about 18 months, made me ill and eventually she moved out....renting the flat to her mum. Hurrah we thought, an older lady and she won't make any noise!

    Wrong!

    Her mother was worse than her and had a severe drink problem. So our sellers didn't tell us the husband had even had a fight the the younger womans boyfriend over their noise! We were advised that yes we could sue the sellers of our house but it would be expensive and we just didn't have the money. Our son learnt a whole new vocabulary and used to get up each morning asking what certain words meant. I did confront both people but they didn't care!

    Thankfully they moved on a long time ago and we now have a lovely single guy living next door! :D
    My second favorite household chore is ironing. My first being, hitting my head on the top bunk bed until I faint.
