Sourcrates - Thanks for the reply, I'll draft up a letter today and get it off tomorrow, as you say the game continues..

You can guarantee they will attempt to bluff there way out of this, so be prepared to bluff them back, if they say you made a payment on such an such a date, then you challenge them to prove it, show them your not going to be a walkover, good luck !!

  • Challenge them nothing.
    Serve them !
Legal notice is served that the debt you are seeking is statute barred and you must now desist from further contact or test the case at a court of law.

  • Hi again,

I received a reply from Robinson Way today. It states that the account remains unpaid despite previous attempts to contact me. Perhaps my letter sent to them two weeks ago doesn't count.

They have still to provide proof that the debt is mine and not statute barred.

Anyway I intend to send a letter of complaint for breaching the FCA's debt collection rules.

    Anything else I should do?

Its most likely a computer generated response, they are farmed out every few weeks automatically, just remind them of your original request.

They always pull that mysterious payment trick.

    The plot thickens...................

After complaining to Robinson Way, and receiving their 'so you've made a complaint bumpf'. I had heard nothing until yesterday when I received another letter from Lloyds stating that we've not been able to agree a suitable repayment plan........ and they're passing the debt to Moorcroft Debt Recovery.

And guess what?? Today I get a letter from Moorcroft asking for repayment.....

Do I follow the same process as with Robinson Way?
Can Lloyds use more than one company at a time?

This is becoming really tiresome, I assume this is what they hope

    Any thoughts feedback really appreciated

    Hi niknak

That does indeed sound rather tiresome. It seems to me that Lloyds may be falling foul of the FCA's guidance on debt collection practices, which refers to the following as a possible example of "psychological harassment":

using more than one collection company at the same time

More on this guidance, and how to complain about perceived breaches of it, can be found in our Harassment fact sheet:

    https://www.nationaldebtline.org/EW/factsheets/Pages/03%20EW%20Harassment%20by%20creditors%20and%20debt%20collectors/Default.aspx

The bottom line, of course, is that you have still not been provided with any evidence in response to your "statute barred" letter. Until that happens, everything else is likely to be simple stalling tactics on the creditor's part.

  • Hi All,

After calling all of the debt collection agencies who said they were no longer handling this I returned to Lloyds. And eventually I got this thing sorted. After a huge 1.5 hour conversation with people at Lloyds they eventually accepted they were at fault. Cleared my defaults and paid me £100 as a gesture of good will which I accepted but gladly but was just happy for it to be over.

Anyway Ive just had a look at my credit rating and there is still a default on there....They've deleted all but one...I'm absolutely fuming.

    here we go again....
