Excess postage!

I guess maybe this could have gone on the vent board, but basically I bought a DVD from a reasonably new ebayer (registered Jan 2005) and paid an additional £2.50 for postage.
On Tuesday had a card from the post office advising a package without enough postage paid and £1.28 to pay - it was the DVD!
I'm now in email correspondence, I've scanned the box to show him proof that I had to pay this (although he says "something wrong with picture"!) and had advised that it's unfair as I paid £2.50 for the postage and he only put a 1st class stamp on it!!!!!! :mad:
He seems to be arguing the point now and saying it's unfair that Royal Mail charged me the excess postage when all the other DVDs were delivered fine and seems to totally ignore my pointing out that I paid £2.50 and he put a 30p stamp on the bloomin' thing.
I can see this may well end up in me leaving negative feedback, something I have never done in over 2 years of ebaying.......

Some people, not just ebayers, seem to have a real block about postage and seem happy to just bung a 30p stamp on the package and hope for the best. It really isn't on.
Be firm with the seller and insist that he reimburses you for the £1.28 you had to pay, just keep on at him.
One other thing though, don't confuse things by arguing about the amount you actually paid him in the first place, that is immaterial, the fact is that you are £1.28 out of pocket and you want it back.

I will send him an email this evening telling him that if I dont receive a cheque by next Tuesday then he'll be getting negative feedback as really havent got time to argue the toss backwards and forwards with him.

The issue of excess postage in the first place aside, It's simple, he failed to put sufficient postage on the package, you had to pay the £1.28... He Owes You £1.28

Firstly, don't threaten with negative feedback if he is clever enough he can use your email to have the neg removed..it's a long shot but not worth risking.
Secondly the idea to which Tojo alludes is dodgy to say the least but would almost certainly work. If you put in a claim to paypal to say you have not received the item then the only proof they would accept from the seller is proof of delivery, ie a signed recorded delivery or special delivery form. As he cannot prove that you received the item you would be able to reclaim the full amount of money paid.
Obviously this would mean that you start the chargeback on a lie but you might want to investigate whether you have any legitimate recourse via paypal anyway as what ever claim you make to them requires the seller to prove delivery which he cannot do. Look under the resolution centre tab when you log into paypal and see if there is any way you can legitimately start the chargeback.

The claim that it's not arrived has no substance because there has been contact between the 2 parties discussing the fact that there's been a charge, or am I just being thick

Phil, I wondered that too as surely he could use my email to prove that I have received the item? I think I'll give that idea a miss as dont want to be done for fraud!!!!!!0
