Credit card company refusing Chargeback

Hello there I am hoping you guys can tell me what to do next as I am fresh out of ideas.
On 17/01/14 I bought a brand new mobile phone from WMicroUK an Amazon Seller with a one year guarantee. After 7 months it developed a fault with the touchscreen which rendered it unusable so I got in touch with them for a replacement. After suggesting I mess around with the settings to fix the phone, they then proceeded to ignore my attempts at contacting them. Amazon refuse to get involved because their guarantee is only 3 months.
I got in contact with the credit card company (through my mother as this was a present) filled out the form that they sent out to us with the invoice and all the details asked for.
This is where things get interesting, about a month in my mother calls chasing up the application and is told the money will be paid in by next statement, next statement comes no money, two weeks later after I badger her for a response she calls them again and they said they never said they would pay back the money and it is still being looked at.
The last statement from the bank is summarised as follows
"Hi I spoke to the manager and unfortunately because the item was bought through a 3rd party ie amazon marketplace and the product was Woking when it was purchased , as they are unable to make contact with the seller and their limit is 120 days they are unable to help.
If the item was bought directly through Amazon it probably would have been a different outcome. How much did the new phone cost."
Is this true? Have I just been screwed out of £130 even with all the safety that paying with a credit card is meant to provide? I really hope you can help because this is the fourth month I have been dealing with it and I have so many ongoing issues that require my attention.

Technically, they're right. Amazon merely processed the payment for another seller, they didn't take the payment for themselves, therefore you're not eligible to do a chargeback against them. The same rule applies if you were to buy something using PayPal.
I'd pester Amazon about it to be honest, but be nice about it. Their customer service is top notch. I had a Sonicare toothbrush that I bought from them 4 years ago, it died last week, the warranty was only for 2 years and they still replaced it for free.Credit 'Score' - Don't buy the credit 'score' that Experian, Equifax and Noddle want to sell you. It's an arbitrary number that means nothing when it comes to applying for credit.
ALWAYS HAVE A DIRECT DEBIT SET UP FOR THE MINIMUM PAYMENT ON YOUR CREDIT CARDS, REGARDLESS OF WHETHER YOU PLAN TO LOGIN AND PAY EACH MONTH.0 -
Could you not send the phone back to the manufacture as it would still be under warranty?0

It was not under warranty it was under guarantee from the seller. Been in contact with amazon they are nice but they can't help and referred me to the credit card company. Well that pretty much makes Amazon and Ebay as unusable sites for me in the future then.0

Yes - the refunds are based on the Merchant having an account with the credit card company. As you've discovered, you paid via an intermediary who passed on the funds on the seller, so with no direct connection, they are not liable.
However, the fact the screen isn't working isn't a slam dunk for replacement. A repairer could decide the fault was caused by abuse and any guarantee be void (even if you could claim).
In your shoes, I'd take it to a repairer and ask for a quote and the cause of the fault. You can then pursue the seller for the cost of the repair, but at least your phone will be working again.0 -
Seller has refused all contact with me even when I try through Amazon Customer Services who have been as helpful as there rather limited powers allow keep in mind the phone broke in July I have long since replaced the phone. Oh well lesson learned don't buy through Amazon as precious few things anyone actually wants are offered direct from them.0

The lesson is buying from Amazon and buying from Amazon Marketplace are 2 very different things...====0 -
