  • Yeah, I know, but it seems to depend on who ran it over, if it wasn't you, you can take it.

    Isn't it the case of you are not allowed to pick up what you have run over, but the next vehicle along can?

    I strongly suspect it's an urban legend. I can't imagine why the law would ever say that.

    It's certainly not true about deer. The Deer Act makes it illegal to remove the carcass of any deer without the landowner's consent - it doesn't say anything about an exception when the bloke in front of you ran it over. (link) I'd be very surprised if it was true for any other type of animal.

    However, before picking up road kill, there are certain laws to be aware of. It is illegal to run over an animal and then eat it so, according to the Department for Environment, Food and Rural Affairs, the game animal would belong to the land owner, which would be the Highways Agency. But if the car in front hits the animal, then it is fine for someone else to pick it up and cook.
    That doesn't make any sense. Either the carcass is the property of the Highways Agency or it's not. If it is, then nobody except the Highways Agency can take it - it doesn't matter where they were in the traffic. It sounds rather like a case of local news reporter phoning up DEFRA and getting through to a junior member of staff, who's told him something he read on the internet... and the reporter then mangles it further in writing his report.

Someone has wrongly interpreted HA to be the land owner

    Pigs, cattle, goat, !!!, sheep, horse, mule and dog are the only animals ( think) covered in the road traffic act for accidents certainly don't remember owls being there

    Here's where Babbawah gets kicked off.

    MSE forum died when Dear Martin cashed in his chips. Almost overnight the traffic went to a fraction of its previous highs.

    A forum is much like a pub, you walk into a pub & if it's empty then you might drink a polite half, or you might just turn heel & walk right out.

    MSE forum is now populated by 'paid to post' types & staff.

    It's an illusion to keep up a pretence. It isn't sustainable.

    The forum will become nothing more than another realm of the troll.
