Now I have a relative whom works in a quite senior role within councils.
Just informing people that this is not a "Formal" fine and is therefore not enforceable.
Its not a formal fine, however a lot of people think it is, and unfortunately this can also extend to some judges on the small claims circuit.
That coupled with the protection of freedoms act means that some car parking company's will try their hand at court, and on top of that they have six years to lodge a claim. Cpp may not be particularly litigious at the moment but who knows what will happen over six[/] years.
Your best plan of action is to read the sticky thread at the top of this board, and to complain to the hospitals PALs service.
After going through something like you have had to go through with the horror of a still birth you shouldnt have to be dealing with scum trying to con money out of you.From the Plain Language Commission:

Thank you@dvtrv - we've been dealing with thousands of people with private parking charges day in, day out. The former advice to 'ignore' these PCNs expired 2 years ago with the introduction of the Protection of Freedoms Act 2012.
There is now a fairly simple 2 (template) letter process that gets rid of this from your life. Yes, you can ignore the PCN, but you will suffer months of letters from the PPC and its debt collection agency, with the possibility of hassling phone calls and a further possibility of the PPC taking you to the small claims court at any time - and for the next six years! Or you can put it all to bed in 6-8 weeks, done, dusted and forgotten.
Your relative/advice person may well be magnificently qualified in consumer law, but I'd ask him how many private parking charges has he successfully guided random people through?
And, despite his qualifications, I'd pit myself against him any day (as would all other regulars on here) in getting you through this successfully. We've dealt with thousands!
But, your decision, your choice. Good luck whichever way you decide to go.0 -

My initial reading of your original post made me think this might be a council ticket as you mention Yellow Lines and a Blue Badge.
If this is the case then it's off to Pepipo.com you need to go.
If however it was on private land then you really need to challenge this and then educate your family member that he is giving bad two year out of date advice that could cause you even more anxiety than you already have. The Blue Badge is irrelevant as it has no standing on private land but the Equality Act 2010 does so PALS and the hospital need a good stiff talking to about this.

Your initial appeal will be rejected but the PPC must supply a PoPLA code that you then use and win, costing the PPC money in the process.

I have to date beaten 10 of these tickets in court for people. All of whom ignored, and all of whom got sued.

A-E do not apply here. I parked on double yellow lines where there was no yellow marks on the kerb which in public roads is always acceptable unless signs say otherwise which I've been advised on by traffic wardens before.
So what do you suggest I do here now then?

I challenge this 'PCN' as keeper of the car, on the following grounds:
a). The sum does not represent a genuine pre-estimate of loss, nor is it a core price term. It is an unrecoverable penalty and not commercially justified.
b). The signage is insufficient, the risk of a charge is not transparent and the wording is ambiguous.
c). There is no evidence that you have any proprietary interest in the land.
d). Your written 'notice' fails to comply with the POFA 2012.
e). There was no consideration nor acceptance flowing from both parties and any contract with myself, or the driver, is denied.
The purpose of this communication is threefold:
1. Formal challenge
There will be no admissions as to who was driving and no assumptions can be drawn in the absence of evidence. As such, you must either rely on the POFA 2012 or cancel the charge if you cannot claim keeper liability. Please uphold this challenge or send a rejection letter, so I can escalate this appeal to the independent appeal service offered by your Trade Body.
2. ''Drop hands'' offer
The extravagant 'parking charge' is baseless but I realise that you may have incurred nominal costs. Equally, I have incurred costs to date, for researching the law, reading your Notice and responding, despite a lack of contract. I calculate both my costs and yours to be under £15 at this early stage, therefore, this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the spurious charge within 35 days without further expense and I will not pursue you for my costs. If you persist then I will charge in full for my time at £18 per hour plus my expenses.
3. Notice of cancellation of contract
I hereby give notice of withdrawal from this alleged contract which was never properly offered or explained by you. The charge is not acknowledged, is not due and no 'service' from you was ever expressly requested by the driver or by me. Neither the driver nor myself gave 'prior express consent' or any consent at all for the alleged contract and it is not for me to reimburse you for foisting an unexpected and non-negotiated contract upon any driver of my vehicle. This 'contract' is hereby cancelled and any obligations now end. If you offer - and if I decide to use - your IAS or POPLA, then the contract still ends immediately on the date of their decision (whatever the outcome) so my notice of cancellation still applies.
As well as not meeting the requirements of the POFA 2012, it is my view that you have breached the Consumer Contracts (Information, Cancellation and Additional Payments) Regs 2013. In replying, you will also be acknowledging receipt and understanding of points 2 and 3 above. Where sent by post I have obtained proof of posting; where submitted online/by email it is deemed received by you unless proved otherwise. I look forward to your considered reply within 35 days.
