the situation has NOT arisen because we failed to notify the TCO of a change in circumstances
the situation is that the HMRC system cannot recognise any salary which does not meet minimum wage so it automatically recalculates the hours worked
Shouldn't it say 'the situation is that the system cannot recognise any salary which does not meet minimum wage, so therefore, I should have made double sure that my son called to make a change of circumstances and explain that he was doing an internership to explain his income'?
From what I am reading, the circumstances meant that it was ever more crucial that you reported that change, rather than it was pointless.0 -
ok before i bow out

It has actually. As you have been told by many different people.
To confirm, if he had called TCO when the change happened, they would have updated the system and put in notes explaining it was an apprenticeship. This would have covered any issues via RTI as TCO would be able to see the notes. Since he didn't call to report the change (everyone has 30 days to report a change to TCO, as per the paperwork) there was no note, no explanation. Therefor the changes were made.

As we used to say
"you are not telling the OP what she wants to hear".0 -
well to update you all
following me phoning the offices of Nick Lodge Commissioner for Tax credits and benefits on Friday I have ascertained the following;
* TCO were informed that my son was working 37 hours per week on an apprenticeship by his employer within the information supplied in the FPS they sent HMRC
* No attempt was made to contact my son to query the information (which was probably because they actually HAD received the information) prior to the closing of his claim
* His tax credit award has been re-instated ( although we are awaiting confirmation of this via letter which may take 2 weeks)
* a letter of apology is on it's way to my son for the way in which his claim has been dealt with and the worry it caused him.
I would like to thank you all for you input and if anyone else finds themselves in a similar situation if they PM me I am happy to give them the office number of Nick Lodge0 -
