Whilst this is true - and it certainly sounds as if he is a shonky back-street trader - SOGA expectations of a £640 car are not going to be particularly high.

I fully understand that and my expectations would not be very high, but that said the seller cant say sorry its your problem if they can be proved to be a trader

They can... and frequently do - but you then have the ability to get redress through the courts. For what that might be worth, in practice.

don't you meant they cant but often do and many just roll over and let them get away with it

that is an article where trading standards prosecuted a trader posing as a private seller so they are interested in such things

thank you for the link, and yes I know my dad didn't do things as he should have, at all...
We are going to wait for the garage verdict. Mainly because if the car is ok we'll just keep it, my dad just paid the tax for it as well as insurance, and I don't know how to go about backtracking these, although if necessary I will find out.
I am, whatever the garage says, going to report him though.

Thank you all for your very valuable input!

ok. So just heard from garage now, they would need to do more work on the engine to figure out exactly what's wrong with it, but it would cost £££ to fix. The car also has other problems, including a slash in the front tyre, hole in the oil tank, etc. According to the mechanic, it seems as if the car was botched-fixed, just superficially.

So this seller isn't only posing as a private seller when he actually does it for money, but is also selling cars in a dangerous condition to drive to unaware buyers...

So, how do I word it to the seller? we want our money back, including petrol to and from another city (yes, my dad is that stupid...), but I also feel very strongly that what he is doing is dishonest and dangerous, I do not want to drive that thing!

Go have a final chat with the seller.
If no refund then definitely trading standards and issue a court claim against the trader with all the evidence you have collected.
I would also look at when the MOT was done and whether there could be implications to the garage that issued that.

I do have sympathy for the OP, makes me wonder how on earth 'normal' non petrolheads buy cheap cars - just luck I guess!

Sorry to hijack this but I've just had a thought. I bought my current car from a dealer, but as a private sale at his house as it was his personal car, had been in his name for a few months. I was perfectly happy with that, car was and remains fantastic, but was it legal?

A tyre can be bought cheaply if this NEEDS to be changed.
Cars do not have an oil tank, you mean fuel tank?
etc - what does that mean?

Sounds like the garage is being as BS'y as the dealer it was bought from.

Please don't tell us you think the car is a death trap either.

A £600er is going to need money spending on it at some point so take the advice given in post #4 and don't let this take any more of your time by turning it into a long legal battle.

No law against someone who works at a dealership selling their personal car as a private sale, assuming they have owned it for a while and is obvious that it was their own car.

Not sure why a dealer would do that though.
