Help complaining to private seller

  • Apart from stalling (every cheap car I've ever bought needed something doing) does it run ok? Have you tried adjusting the tick over speed?

    FSH (if it did have it) is pretty worthless really, on a £640 car . See what the garage say on Wednesday.

    I myself have a vw polo from 1998 that was £700, it had full service history and hasn't given us any mayor problems for a whole year, so I don't think to 'expect' this is unreasonable.

    Obviously it won't be perfect, and the service history itself wouldn't matter on its own, it's the other little things that bother me. Yes we have to wait and see on Wednesday.

    I've just googled his phone. he has sold four other cars this August on Gumtree, plus more in a local adverts site... do I have a fight on my hands?? what do I do?

    To clarify, my dad was idiotic, the guy completely gave him the blurb and my dad was overwhelmed, and made the mistake of going on his own, I know nobody 'made him' buy this car, but the seller took advantage of him and his vulnerabilities.

    where did you buy the car from did you go to the sellers house or did you buy it from elsewhere?

    if you can prove that he is a trader then you may have some rights, even if he is a guy selling cars from his kitchen then he could still be classed as a trader

    if he is a trader then he can't hide behind sold as seen and things like trade sale

    did you get a reciept and what has he written on it ?

  • I've got about 10 ads (screenshots saved) with his phone number selling different cars, all with the same local area and photos taken in roughly the same space. He is good at deleting them as soon as they are gone, but you can see the cached page on google.

    it does sound like a dealer pretending to be private seller in an attempt to shirk his obligations to the buyer

    if you can prove that the seller is really a dealer then Sale of Goods Act applies, what name and address was on the V5C was it the name of the person selling it or somebody else?

    your dad has left himself open in so many ways and you should never buy a car without getting a receipt, and not checking things out properly

    before spending money getting things checked out i would go back to the seller and tell him you are not happy with the way the car is running, explain to him that you believe he is a trader due to the number of cars he is selling and you expect him to deal with this issue, if he wont talk to you then text him and tell him your next visit is to trading standards

    When buying things privately the seller is almost as important as the item you are buying.

    Whilst this is true - and it certainly sounds as if he is a shonky back-street trader - SOGA expectations of a £640 car are not going to be particularly high.
