So Confused - G24 Contractual Parking Charge Notice

So sorry to ask, what has probably been asked a million times. I have spent the last 3hrs reading loads of the threads on this forum about parking charges, but due to a brain disorder, am at times unable to get my head around everything, and at the moment my head is spinning, am totally confused and very upset.

I have today received a Contractual Parking Charge Notice from G24 for £100 (reduced to £60. if I pay within 14days), for overstaying free parking. Must admit I never looked for any signs, did not imagine there would be, being a small retail place.

Do I have to pay this, after paying bills etc. from my ESA received today, I have £20. left for the next 2 weeks. If not, what exactly do I do, the letter has pictures of my car on it, with the date, entrance, exit times. I don't even know who their client, who is mentioned in the letter is, there are only 4 stores and 1 KFC on this site. The site in question is South Bristol Retail Park, BS3 2LQ. The car park is quite large, and there were at least 50 spaces with no cars on, so this seems to be extreme. Between my friend and I over £100. was spent in one of the stores.

Sorry again, but this is my first ever offence, in 40yrs of driving, and I am panicking.

    no you dont have to pay it, appeal it

    if it was before oct 2014 , they were in the BPA so just use the template letter in post #1 of the NEWBIES sticky thread, then post #3 for popla

    that thread is the only thread you need to read

    also complain to the landowner and retailers, try for a landowner cancellation

    dont admit who the driver is, appeal as RK only, no giving things away !

    Thanks for replying, it was on 24th Sept. Issue date 1st Oct.

    Sorry for more questions, but do I send a letter to the address on the CPN, or is there an e'mail address I can send it to. Do I have to send the same letter to
    post #3 for popla at the same time, or wait for an answer from G24.
    Also is this what I send, if so can I copy and paste it.

    I refer to the above notice which I challenge, not as driver but as keeper of the car, on the following grounds:

    a). The sum sought does not represent a genuine pre-estimate of any loss and yet it is intended as a deterrent, so the charge is a penalty.
    b). The signage on site is deficient, the wording unclear and it fails to comply with the Code of Practice.
    c). In the absence of any evidence it is my case that you lack any or sufficient proprietary interest in the land.
    d). Your notice was deficient and fails to comply with Schedule 4 of the Protection of Freedoms Act 2012.

    This is my formal representation. There will be no admissions as to who was driving that day and no assumptions should be drawn in the absence of evidence. I have decided to appeal this as keeper and as such, you must either rely on the POFA 2012 or you must cancel the charge if you know you cannot claim keeper liability in this case. Please uphold this challenge or send a rejection letter, so I can escalate this matter to the independent appeal service offered by your Trade Body..


    How do I know "Your notice was deficient and fails to comply with Schedule 4 of the Protection of Freedoms Act 2012" applies.

    I do not know who the landowner is, only the retailer stores that are on the site.

    Sorry for more questions, but I am just lost, and really appreciate your help.

    With G24 you can appeal via their website. Your appeal is fine ( bar you've repeated the last paragraph ).

    As for the notice being deficient - oh, I promise you as this has come from G24 it will be.

    G24 will respond with a rejection and a load of lies ( like they've taken legal advice - which they haven't ).

    You just need the POPLA code - it may be an IPC code as G24 recently jumped to a new trade association but we'll cross that bridge if and when we come to it.

    The only number I have on the CPN is the charge number, where do I get the popla from.

    I will contact LaSalle tomorrow, obviously I will not own up to being the driver, just state I am the registered owner, should I put that a lot of money was spent (which it was), in a new store that has just opened there, any other advice as to what to write, would be greatly appreciated. Thank you

    Yes, that's the link. You don't get the POPLA / IAS code until G24 reject your appeal.

    You won't get a POPLA code until they respond to (and inevitably reject) your initial appeal.

    Only mention the money spent WITHOUT saying 'I' or 'my'! You only add something like 'the driver and passenger spent £xxx and here is a copy of their receipt(s)'.

    Thank you all so much, I have just sent the letter to G24, and will now set about e'mailing the landowner and every retailer on site.

    I will report back with any replies I get. Still very worried, and hardly slept last night ):
