Settled out of court with a non-disclosure agreement?

For legal reasons I officially deny your supposition.

This is getting like House of Cards ... "You may think that, I couldn't possibly comment". :D

I'm bound by the client's undertaking. For the record, I wish I'd got the LR extract 2 days earlier...
  • There was a reason why Devere asked for this, but for legal reasons I can't tell you why.

The key word is asked and it might have been a different Judge in different lodgings (and work that one out).

  • For my two pennies worth :)

Whilst the sentiments for Devere may appear too be above board in this instance and signage removed due to the lack of locus proven - there are other factors to be considered:

Devere are now members of the IPC - jumping ship before pushed - thus signage across their sites will all be changed.

A leopard does not change its spots - and indeed there is evidence that Devere have a particular habit of operating without authority from landowners - and YES I can back that up with proof !

They also threaten motorists who dare to suggest they don't have a valid contract in place.

With regards to the BPA and DVLA inspections - there is none !

Members of the BPA simply sign a document upon joining the AOS that they will abide by the Code of Practice and that upon getting RK details from the DVLA they are deemed to be approved. The KADOE contract obliges them to follow the code of practice - but in essence no formal checks are done. The cycle between the BPA adherence to the code of practice; the DVLA and POFA has not been determined in court (although this has been included in once defence for an OP on this forum - unfortunately they bottled out and paid before a hearing )

What options do previously ticketed people have, seek refunds directly from Devere or through courts, complain to the BPA (seems waste of time) or DVLA- but about what? And those who settled through mediation or out of court...

A formal letter to Devere would seem to be the obvious approach. They may well blame their principals but that doesn't in anyway absolve them of any civil liability and it is for them to make their case to their clients.

Are Bournemouth Echo aware of this story yet?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

The issue is that they don't know about it and unless the local paper reports it, they won't know.

Local papers want details and quotes from parties involved and that is why I do not approve of Mr X accepting help from the lay reps, but then wanting anonymity, (if that is the case). "I'm all right Jack, but s0d the rest of you".

DeVere is also the name of a hotel chain.
