Next time I down a pint wasting £3 or so (probably tonight) I will think of the £3 well spent in Land Registry fees obtaining that critical information for this court hearing.
Well done all those who helped the defendant. It seems he/she got a judge who knows the law.REVENGE IS A DISH BETTER SERVED COLD0 -

Fistral springs to mind0 -
Additional paragraph where the land is not owned by the client(e.g. ALDI land where they are not the landowner)
"I note that the parking company has not been engaged by the landowner, but by a lessee or tenant of the land. I require proof from the actual landowner that their contract with the lessee/tenant gives authority for any form of parking restrictions or charges to be brought in. (There are VAT implications when a car park is a revenue generating business that may impact upon a landowner and that is why it needs to be established that they need to have granted permission in their lease.")0 -
Devere should not be let off the hook lightly. They are aggressive and ruthless, now their backs are on the ropes and we feel pity, no way. They have been unforgiving and ruthless towards blue badge holders and thats unforgivable.
I thought the DVLA individually inspect these contracts, my !!!!, how did they miss this one then. Does this mean that keeper details were obtained unlawfully?
If Devere genuinely make changes, then thats good. But when you call them, they are so rude, they need to change wholesale.0 -
I won't give the surname as the regulars who helped will know whether the defendant would rather not be named which is often the case.
But we can call it 'Devere Parking Services v Mr X' and the case number was A3QZ5517 heard at Bournemouth on 3rd October 2014.
Added to that, I have asked this poster for their POPLA Code and name of Assessor as this POPLA decision backs up this case:

...that one was only Highview but the eagle-eyed Assessor concluded 'I am unable to determine who the landowner is and so cannot find that the operator has the authority of the landowner for their activities. Therefore I cannot find that the charge notice is valid'PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Devere asked if the judge would order that the result be kept confidential, as otherwise this would appear on the Parking Prankster's blog to Devere's detriment.
Ermmmm, am I missing something, or isn't it a cornerstone of The English Justice system, that justice should be open and transparent ?Illegitimi non carborundum:)0 -
