Advice with Court Claim received please?

    Time for court I'd say. You've done all you can.

    Well it will go to mediation first and then depending on the outcome of that, it will go to court.

    I am still baffled that the buyer is pursuing this given that he refused to return the sat nav for a full refund.

    Looking for some advice...

    I sent off the form to agree to mediation on 16th October (as it had to be received by 20th), however, to date, I've not heard anything else. It's been 20 days since their deadline, so just wondering how long it usually takes to be contacted by the mediation service.

    I've logged onto the MoneyClaim website and it says the last update was me filing my defence.

    If you defend, the claimant receives notice of that and then has to pay again to proceed to court. He can also agree (or not) to mediation. So, it probably takes a week to process your defence and then another two weeks to sort out the claimant and then another seven days to process that, so at least another month. I think the last case I had took six months to get to court from my defence. In that case the claimant was trying it on and didn't even show up to court, they ended up paying my costs.

    Phone the court and ask where the case is up to. They're usually pretty helpful over the phone.

    Thanks RFW, I have already filed defence and the form offering mediation came through. The claimant has agreed to mediation (as he sent me a copy of the form he signed) and I agreed to mediation on 16th October. I will give the court a call.

    Just an update, I received a notice of transfer of proceedings today. The case has been transferred to my local county court which will likely irritate the claimant as he had requested it be heard at his local court.

    I phoned the court and they said it will go to a judge to decide whether it's suitable for mediation or not.
