    My Partners brothers name is on the contract although money comes out of partners account, Partner was in a carehome and is now out and back home,( was easier for his Brother to take care of it while partner was in carehome) did change name back over 9 months ago but EE wouldn't change said we had to go to a shop to prove who he was we did but they still wouldnt change over , his brother lives over 200 miles away , he has phoned them several times as well to confirm change of name - they just wont listen dont really see the problem as money comes from partners account, New phone went to his bro as they had his address , he called us straight away to ask why it had been sent to him, ob still not listening ! he returned it with driver straight away , they said they would deliver to us the following week but it never arrived - have told them this as well -

    There may be other reasons as to why the account was refused transfer, your partner would have had to pass the credit check for example.
    As the account is in the control of the brother it needs to be him that deals with it not you or your partner. You won't get very far with it yourself due to data protection regulations etc etc.
    As it was not the account holder that took the extra contract out it needs to be added to the list of rejections.

  • been quick enough to take out payments ! he is disabled so only has a limited amount of money going into account but has been paying full since having the account expires Dec this year def wont be going with EE again - his Brother has contacted them as well and told them the situation - didn't seem to care when changed to new contract , although that is not what he was sold - it is just annoying when the girl said she could see what had happened and they are still not dealing with the refund of payment , and he is not getting anything for payments made ...

    The source of the payments are of no interest to companies providing they are paid by someone and it doesn't have to be the account holder. If payments are not made it's the named account holder that is held liable.
    The brother needs to write the complaint and request the contract is ceased and all monies refunded.

    You still have not clarified whether this was EE directly who called as this can make a big difference. Do you know the answer to this? Because IF it was a third party dealer, by contacting EE, you are barking up the wrong tree so to speak.

    And as Silk says, the account the Direct Debit comes from has no bearing on the account itself. Just because you pay the DD, doesn't mean you can automatically take over the contract.

    So why don't you just cancel the direct debit and leave it up to the brother to resolve. You say it's in his name, therefore it's his contract to maintain or resolve with T-Mobile, and he should be making arrangements to pay it.

    By rights, T-Mobile shouldn't even be discussing your brother in laws contract with you.

  • It IS my partners contract -his brother was looking after it for him, while partner was in care home . all he wants is contract which was agreed at slightly lower price not two payments to be taken and an extra line, which was never agreed , Partner is now home and just wants everything back to his name, we are scared to cancel either incase they take the big penalty they have said they will . even though I was told it was misold by T- Mobile ( part of EE) the rep sold it using EEs name not T-mobile if he had said T mobile we wouldn't have bothered. Had no reason to check as bought as renewed contract at cheaper rate - NOT a second line - Will ask his brother to put everything in writing , as will we - we have both phoned and explained still nothing is being done and money is still being taken from account twice in one month - thankyou -
    it will get sorted but as partner is disabled and on benefits dont want to get into debt though a problem not caused by ourselves - they have already had over £100

    If it is in brother's name, it IS NOT your partners contract. It is his brother's.

    Again, you need to get brother to double check where it came from because third party dealers will often make it seem like they are Calling directly from the network.
  • On the bank statement it is coming up EE - Tmobile the same as orignal contract - have just emailed his brother to write to them explaining the situation . Thankyou for all input x
