Just out of interest, i have found a mistake on it, a clerical one, they have my reg right but the car model is spelt wrong?
Not sure if that can be counted as a technicality worth pursuing?0 -

Nope.

EDIT - WHOAAAA
Just converted your links above, but on opening them notice your personal details are all over them - you need to redact all your details, the car's VRM and anything else that links this ticket/NtK to you personally. Then re-submit the links here. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

A pathetic hybrid NTO/NTK/LBC letter (!!!!!!?!):
http://s64.photobucket.com/user/brambleanddaisy/media/opc1_zps14b01870.jpg.html
Point 7 in the letter is wholly misleading about your options which appear to be restricted to 'pay up' within 28 days to avoid it escalating to £300 !(which is a lie, because the POFA sets a statutory ceiling on the amount that can be recovered from a keeper- and it's the amount of the stupid PCN only!).
And point 10 'details (of POPLA) will be made available at the appropriate time' is also a breach of Schedule 4 of the POFA because this Notice has to describe/explain the appeal options and processes for challenging the PCN or complaining.

Terrible appeals form with no space and the word 'excuses' and trying to steer the appeal:

Form about the DVLA and ICO:

Forget that. Not a point that will win at POPLA.they have my reg right but the car model is spelt wrong
Could we see the sign please? A few of their pics which show where your car was parked (cover up/paint out the car reg).
Also start working on a draft as we won't be writing it from scratch but will help you once you've written the first draft. Search this forum for 'OPC POPLA' as we have had a few OPC cases recently and I reckon that search of the forum will find at least one 2014 OPC POPLA appeal that would give you a base to work from.
Tell us a bit more about the circumstances of the parking without saying who was driving. So tell us why 'the car' had no permit showing, and what was happening, was it a private block of flats and did the person live there or were they a visitor, did they have a permit or just not see any signs?PRIVATE 'PCN'? this is the pic of the sign that was taken at the time of the alleged offence, unfortunatley my other parts of the letter i got from them (the pictures) got binned somehow.
The car was parked in a residential area (not in a bay) along with around 15 other cars in a straight line down the side of the flats. It was parked after reading the sign and seeing the caption 'visitor parking restricted to 4 hours on site' and seeing no other wording that described that visitors needed a permit of any sort. The car was parked so that they could use their friends flat to let their 2 1/2 year old to use the toilet. 15 mins max, certainly not 4 hours.0 -
What an ugly yellow sign with an unreadable middle section:

Wow it still has a whole section about towing vehicles away (removal) which is ILLEGAL and has been for two years!
That sign is a mess, as is the NTK as mentioned before. So start working on a draft as we won't be writing it from scratch but will help you once you've written the first draft. Search this forum for 'OPC POPLA' as we have had a few OPC cases recently and I reckon that search of the forum will find at least one 2014 OPC POPLA appeal that would give you a base to work from.
If no luck after searching (and DO look as you will find OPC threads) then just look at the links under 'How to win at POPLA' in post #3 of the Newbies thread and find one about a different PPC but a similar circumstance of not displaying a permit. Sounds a bit odd though because from your description, in fact your car was 'out of a marked bay' wasn't it?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes it wasn't in a marked bay as they only supply one bay per flat, and obviously people have more than one vehicle so they have to park in places without bays in the controlled area0

OK so, show us your draft POPLA appeal, which you can create by reading a few examples of windscreen ticket cases in the 'How to win at POPLA' link I mentioned already. Change the name to 'OPC' every time and adapt wording to suit i.e. if you are reading an example which talks about not being able to see signs in the dark then lose those few words from the unclear signage point, if your case was in daylight. And so on, soon you will have a draft to show us and we'll help perfect it to a winner.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
