Did you report the fault to the trader and ask them to provide a solution.
If you did not and took it to another garage first, you are on a sticky wicket.
You have to allow the trader to redeem the situation first.

Do you have it in writing that the garage you bought it from refused to fix it after the warranty ran out?
The scooter was clearly not fit for purpose.
We have exactly the same problem at the moment, but sadly ours was £8k and a private sale, so no leg to stand on...Should've = Should HAVE (not 'of')

If it is a technical question then I try to answer it, if a matter of opinion then I opinionate. Your contribution to this thread is pretty bizarre and totally irrelevant.
A bit of a guess that it might be Chinese but lot of kid's motorbikes are made in China, as a mechanic, collector and with motor trade experience I always strongly advise against buying them. A lot of dealers won't even touch them.0 -

Technical term? yes - in extreme case (unlikely on a 50cc or 125cc) a con rod can break or a loose big end nut can hole a crankcase, so the engine is a write off. This is most unusual, also big holes in motors belchin oil tend to get noticed by even the most mechanically inept, hence my guess that the 'new engine' bit is nonsense.
More likely a top end rebuild required, particularly if a two stroke.
Running without correct oil will turn ruin a perfectly good motor in minutes - not unheard of with kids bikes.
Agains, strongly advise against buying chinese junk.
As for the legal situation, as outlined earlier, OP taking it elsewhere and spending a whacking £150 on diagnostics has probably blown his case. I'd appreciate your view -if you have one.0
